Did not park between marked bays

I just parked my car - lined it up in the row - car park not full - but I wasn't parked in marked bays - Unfortunately and wrongly - I didnt even check. On Robin Park car park Wigan. Bought a dog collar Pets at home. Got back - sticker on windscreen. £100 fine as not parked in bay. 2 photographs taken it says on notice. I was wrong - but £100 penalty seems harsh. It was not busy. It says £60 if paid sooner. CMS fine - do I have to pay it? I just didnt notice the lines :(

    No, you certainly do not have to pay it. But you will have to read the Newbies thread at the top, see here, to see how you can get it cancelled.

    Nope you don't have to pay it. Read the newbies thread for the process but it's essentially:

    1. Wait until Notice To Keeper arrives in post
    2. Appeal as Keeper
    3. Upon rejection, appeal to POPLA.

    I did read the newbies thread but thought as I was in error - I should have checked the white lines for the bays - it would be pointless appealing

    CMS are an IPC member, are they not? So it would be IAS rather than POPLA.

    Check some recent threads such as for Link Parking ... IPC members need to be handled more carefully. (Or ignored, depending on your viewpoint, and whether the parking company are litigious - CMS don't appear to have been litigious up until the end of March 2014).

    PS - you're falling into the trap they want you to: you made a mistake so you are liable. In what parallel universe do you think that their "punishment" in any way matches the "crime" you committed? If you want it all to go away for only £16 ... http://parkingticketappeals.org.uk/ (if they do handle IPC/IAS appeals).

    My advice at the moment would be the same as Bods

    You can appeal, have it rejected, appeal to IPC and possibly have it rejected or accepted depending on the signage (and the what the signs actually say make a difference, not how many there were etc) . If rejected as some seem to be in recent months, you can then sit out the barrage of empty debt collector letters you will get until they either a) get fed up or b) take you to court.

    Now as bod says, CMs have no history of court proceedings, however this could change. 2 years ago Parking Eye didn't take that many to court, this year since January over 17,000 cases. So things could change.

    Ironically we need a few cases to go to court to win on so that we can get legal precedents to put before IPC but this will take some time with these new players in town.

    If you don't France all that then parkingticketappeals seems a good way to go. They will sort the issue for you one way or another.

    If you do want to use this service contact them soon, before you get your notice to keeper.

    If you want to do it on your own with our support, then await the NTK.

    Seriously?! Even though the Newbies thread opens by telling all posters at the start that you ALWAYS have a case to appeal a fake PCN from a private firm, no matter what the circumstances? Wow - you need to read it again...as ever, this is covered in the sticky thread!


    Sadly, last year it got silly as we could not keep up with all the ''help I have got a private parking ticket, what do I do?'' threads so I wrote a sticky thread BEGGING newbies to 'read these FAQS first'. It was to avoid unnecessary new threads we couldn't keep up with...all the advice is in one place.

  • I have still not received this Notice to Keeper since I first got the charge on 19th August. Now it's 21st October. I think that I read somewhere that they needed to send it within 58 days - it's now over 58 days. Does that mean I can ignore it when it comes? Or does it mean they aren't bothering to send one out?
