Given that the Op has spent the money and obviously the bank want it back, I'm presuming that the Op wouldn't have the £5k to pay back in one go, would the bank then take it back in instalments? How would that work? :huh:0

They're effectively a creditor, as on the OP's version of events they did not dishonestly spend the money, so no crime has been committed.
That means they'll be able to use the same procedures available to other creditors, i.e. they can set up a payment plan or apply to the court for a CCJ.What will your verse be?

Thanks for the reply Matttye. Has never happened to me but it seems to be quite a common thing from the replies on here.
Mistakes happen on both sides and people are human and fallible I guess, although from reading some of the replies to this thread I am wondering if some of them aren't a little chilly all the way up there on their high horses!
I think if it happens to me I like to think I will be putting it in a safe account and waiting until the bank asks for it back but I think it is good to know that if I spent some in error I could pay it back in instalments or something.0 -

I doubt it is quite common - - it is a fraction of the payments that go correctly. If everybody would report all the payments they received, you would have a real job finding the few incorrect ones.0
