    Oh i'm sure the OP probably knew the money wasn't theirs or from HMRC. Lets face it wouldn't have said Halifax as the payee if it was from HMRC now would it?

    When I got a tax rebate paid into my account the reference number was HMRC then my tax number, that was the give away it was my tax rebate that I had been expecting.

    Depends how closely they checked. I would definitely notice. There's not a transaction that happens in my account without me knowing, but not everyone checks their account as often as I do.

    Also depends on how they checked. E.g. if I look at the Santander app on my iPhone, the reference is not visible when looking at the transaction list. You have to tap on the transaction to go into a view which shows more details in order to see the reference.

    Theft is a crime of specific intent. It requires dishonesty and an intention to permanently deprive.

    Ignorance of where the money came from would be a defence to theft in the circumstances given by the OP.

    How would the OP know in advance how much of a tax rebate they were getting? I came home from work one day to find a cheque for about a £200 tax rebate.. I had had no previous correspondence about it. I'm not an expert on how these things work, so it's a genuine question.

    If it can be confirmed that a tax rebate was due at around that time, then the OP's story is quite believable.

    The OP never mentioned any app.

    You find out how much your tax rebate is from a letter the HMRC send you, usually well before they are actually sending the payment.

    Why are you trying to make a case for them not knowing? The OP has acknowledged the money isn't theirs.

    OP said they genuinely had no idea until Halifax brought it to their attention later on.

    It's everyone else who has tried to make the OP a villain. I'm simply saying that what the OP says could be true.

    I don't understand why people can't just take posts at face value rather than trying to suggest everything is a lie.

    It's not immediately obvious you can click for more info. There's no button that says 'click for more info' or anything - you just tape on the line in the list and it opens up a view with more info about that transaction.

    I think most people would look into it further, but it doesn't matter what most people would do, it only matters what the OP did, and she says that she didn't know. It's not for us to start accusing her of lying.

    Technically not true, it was in my account before the letter telling me it was going to be reimbursed into my bank account arrived.

    It arrived 4 days after the payment went into my account, good old slow delivery by the Royal Mail.

    Please see my other posts for my surprise when I found myself in that very position, I made a mistake and put money into the wrong account and assumed that seeing as I made the error, I'd be the one who lost out.
    I abide by the law as it is, I still disagree with it though.
