I think ive been scammed.

  • Yes I totally agree I think its complete bulls**t. Ive called Barclaycard 6 times now, every time they tell me I have to wait until the transactions are not in a pending state. The longer I leave this the more time Im giving this person to disappear. As it stands, all methods of protection are exhausted EXCEPT the chargeback law on my credit card.

    - Ebay not interested as he refunded me initially and continued the sale outside of ebay
    - Paypal not interested as I sent 2 split payments therefore breaching their buyer protection rules.
    - Section 75 law on my credit card does not apply as im using paypal to send the payment

    Im praying that Barclaycard will cover this via chargeback. Ive been using ebay for 11 years frequently and have never been scammed a penny. I actually feel more angry at myself for being so oblivious to the clear signs that this was a scam. My impatients got the better of me and I rushed a sale to grab a bargain and its backfired. Ill keep you all updated on this and hopefully this thread will be available to others who are in a similar situation to me.

    In the meantime I sit and wait by my online CC statement for it to appear...

    Paypal protection applies not to ebay purchases only, but there can be other technicalities in your case. Are there any proofs that the second transfer was a payment for something?

    Did you mark it as a gift or for goods?

    Sending it to his other paypal account is probably the scam as its not covered by ebay refund policies.

    Next time go to PC World !

    It sounds very much like fraud, so you should at least report it to Action Fraud straight away.

    Also, according to the Met Police:
    Local police should take a formal report of fraud in the following circumstances, known as ‘Calls to Service’:

    Where the crime is in progress, or about to happen, including where a delivery is about to be made or money is at risk (a payment may be stopped if action is taken immediately).

    Perhaps that last bit about 'money at risk' applies here.

    To help the police, try to gather any info you can that would help them.

    You can request the fraudster's contact details from ebay (but they may well be fake): http://www.ebay.co.uk/gds/HOW-TO-GET-ANY-EBAYERS-CONTACT-DETAILS-TEL-NUMBER-/10000000003198457/g.html

    If he/she has bought stuff on ebay in the past, you could try contacting the sellers to explain what's happened and ask them if they'll tell you the address they sent their goods to.

    You can also try googling his/her mobile phone number and email addresses to see if they show up any clues.

    I paid as 'goods' with notes on both payments 'Payment for X Laptop new and sealed'.

    Ebay inboxed me shortly after I sent the payment saying that the paypal account -

    'We think Monarch533 has been used without the owners permission'

    [FONT=Arial, Verdana]This tells me that the scammer has no link with the previous activity in the ebay account hes been using to scam from.[/FONT]

    [FONT=Arial, Verdana]Ive now logged this with both the police and action fraud. But its looking very slim with the lack of info I have on the person.[/FONT]

    Ok I called Barclaycard again... constantly pushing them to cancel the pending payments I made. They refused and say because I authorized it initially, they cannot just cancel it. 15/08 is the earliest I can dispute this, and it will take roughly 7-10 days to investigate the payments. What they do is reverse the transactions then investigate it. So I presume this will be a dispute between paypal and Barclaycard as the scammer has already withdrawn the money and deleted his paypal account.

    I did ask if I will be liable for these payments and they said I will not :S. I recorded the conversation just to confirm this..

    Then if you open a non- Receipt case on both transactions if the seller cant provide proof of delivery then you will get refunded, its that simple, ignore it being a split transaction, ignore it being outside ebay, you paid £500 for a laptop you didnt get, You also paid another £500 for a laptop you didnt get

    Is there more to this story you arent sharing? When you said "paypal are saying they wont refund" How did you contact them?

    Im telling you everything in all honesty, Ive called paypal 3 times. As soon as they hear the words split payments they interrupt me and say im not covered, absolute joke.

    Updates on the credit card situation: Ok so finally the 2 transactions are on my statement! I can finally start taking action… Called barclaycard this morning and they have 'suspended' these 2 transactions. Im awaiting a dispute form that i need to sign and return to them so they can investigate it. This still leaves me with no hope as I personally think they will just say i authorised the transaction and used paypal as a medium so I am liable for all costs… We will see.

    I guess this is all i can do for now? Ive been told to keep pushing for a chargeback, however I dont think this is possible if ive just opened a dispute on the case? The nightmare continues...

    Ok, stop calling paypal, use the system to your advantage, Have you opened disputes on the seperate payments claiming non reciept? Dont mention split payments or anything of the sort, if he cant provide delivery details they should find in your favour and get your money back, fingers crossed he doesnt reply to the dispute and it will automaticaly go in your favour

    Yes, both disputes are open for both transactions totalling £1022.

    Ive managed to find the dispute forms online for my Barclaycard, and I need help with them. I have these 2 options which apply to me:

    1) Goods not received or as described
    - provide copy of original invoice
    - terms and conditions
    - Warranty
    - Copy of all correspondence
    - Any other relevant information

    2) Refund not processed
    - Copy of refund voucher confirming refund is due

    Which one do I choose?! The scammer sent me fake emails saying that a refund was being issued by paypal, so should I go for 2) ?
    Or do I go for option 1) and say the goods were not received??
