I can't see Vinci taking it to court as I have in my possession proof that the contract states 75% of monies goes to the trust, so how can they claim for all the money when it doesn't go to them? I have ABM Health Trust contract but they will be similar across all boards, an FOI request will unearth the contract with vinciWhen posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

Does her permit actually have specific hours on it, or is it 24hr but only in the permitted area?0

It's a 24 hour permit for the designated area but a ticket must still be purchased. The ridiculous thing is that the tickets are for a maximum of 12 hours so if a shift goes on for 14 - 16 hours (which they can), nobody is able to leave the department in order to re-purchase a ticket (this would be ridiculous).0

One final thing; would it be true that the Court could only award damages equivalent to the financial loss caused by the damage to the property caused by you. They would also have to prove you had no right of access. Given that, as a NHS employee, you would be using the car park, a Court would deem that you did have a right to enter and use the car park provided, thus rendering the charge of trespass un-enforceable??
In theory, the first part of your question is 'correct' although there are many cases of small claims courts deeming a £100 parking charge to be 'reasonable'. The SCC is a lottery in the context of private parking charges and is a place to be avoided. Having your 'day in court' could backfire spectacularly.
The second part of your question is extreme speculation. One no doubt a pub expert would take great delight in offering you his sincere opinion and advice!
Trespass can only be pursued by the landowner - who Vinci are most certainly not. And I can't see any employer ever considering suing a member of their own staff for turning up for work!

Honestly, the last few hours have been hell. I'm on holidays at the moment (no guessing my profession) and this hasn't exactly been the best way to start it. I'm ever so grateful for you folk putting me at ease. I will ensure she is stocked full of £1.50's on a daily basis though I should imagine the PCN's will continue given the outrageous set-up for NHS workers at this particular trust. Astonished it's been going on for so long.0

Won't that give a contradiction now though? If the main mitigation is she is unable to purchase a ticket due to pressures of the job, then suddenly does start to, it makes the mitigation look weak.0 -
I think your wife needs to raise this formally with the Trust because clearly as an employer they cannot allow their employees to be put in this Catch 22 situation of being forced to park wherever they can to deal with emergencies, yet by doing so invokes a parking charge.
The stress this must bring to staff surely has health and safety/welfare at work connotations? What about your wife's staff representatives; they should be brought into this!
This is absolutely the case. If their job means that they can not walk out to purchase additional tickets, then the union needs to become involved.
Would the Trust prefer the publicity if nurses, doctors and assistants walked out at the end of their nominal shift time mid operation?
