Rubbish neighbours on both sides

Options
Hi all

Bought and moved into my house in August 2013 and all was wonderful, until about January 2014 when my neighbour got a new boyfriend who moved in. He has a throat clearing issue and constantly does it day and night. It really travels through the wall and makes my blood boil. I politely asked him to stop it and he was really nice about it first time, saying he'll try and do something about it. To be fair, he did go to the doctors and got some medication (which, by the sounds of it, has proved useless). I am pretty sure it is not a medical condition, rather some sort of nervous tick. Things have turned nasty when I asked him to calm it down again. Him and the girl kicked off at me (even though again I asked politely). He did then calm it down (proving that he can consciously stop it). What would you guys do/have you been in a similar position and what did you do?

On the other side of the wall are 2 flats. The bottom flat has been occupied since I moved in. The top floor was rented out in around May 2014 to DSS tenants, who smoke week day and night, are up and making noise till about 3/4am every day as they clearly do not have jobs. I have written to the landlord and am awaiting a response. My question here is - What actions can I take if he fails to do anything about it? Can the landlord be ordered to not rent out to DSS tenants? By the way, is it legal for the landlord to be registered at the address of these flats? His title deeds list him as living there. I had to do research to find out his home address.

Don't think you can stop throat clearing or smoking in their own properties.

If making noise at 3am is loud music partying, etc then you can contact the noise team at the local Council (Environmental Health). If it is just being up, talking, whatever, then again too bad.

It isn't really anything to do with the Landlord; the behaviour issues of the tenant are treated no differently than the owner occupiers the other side.

    Throat clearing?
Sorry who is the problem neighbour here?
If you had a neighbour with a wooden leg I suppose you'd complain about the tapping noise it made too?

And people daring to talk and smoke in their own home? How dare they !
I work a late shift and finish work at 11pm so often by the time I have wound down from work ,talked about the day etc it can be quite late. Maybe I'm your neighbour and your assumptions that I don't work are wrong !!

I would suggest that you have bought a property that does not have sufficient sound insulation - so you should rectify that problem on the one side.

I find it horrendous to think that you feel it reasonable to suggest that a landlord "be ordered to not rent out to DSS tenants?"

Fortunately that is a totally unreasonable suggestion. Whether or not the landlord has the permission of his building society to sublet HIS property is none of your business.

Think about moving to a detached house if your neighbours annoy you so much.

You sound like the neighbour from hell. Fortunately there are no laws that can force a landlord into renting out only to those who don't have health or employment issues.

Have you considered building yourself a log cabin deep in the middle of a forest, allowing the rest of the population to get on with their lives?

  • You should swap with me. I'm trying to sell my house and the HA house opposite has the electric meter door broken off and just chucked on the floor and some lovely person has graffitied "Name"IS A SH*T FACE on her side wall, right opposite my front door.
I must remember that "Money Saving" is not buying heavily discounted items that I do not need. :hello:

I don't. When I bought my house the neighbouring houses on both sides were both owner occupied. They are now owned by private landlords. Over the last few years there have been numerous tenants and without a shadow of a doubt the better neighbours have been those in full time employment. The reasons for this are obvious.

That's just one of the risks of homeownership. Neighbours can change. And no the reasons aren't obvious to most normal people. Plenty of disabled and unemployed people are decent , considerate and honest and plenty of people who work are scumbags.

You've had a lot of pretty negative responses from other users so far, but I do sympathise with your situation and how you feel.

Our homes are the places we retreat to after a hard day at work and we expect to be able to relax there - I'd hate to not be able to do that.

But, is the guy next door clearing his throat intentionally being a pain - I doubt it. So the onus has to be on you to sort that one out. Turn the TV volume up (but not too much), think about ways to create better sound insulation, get some ear plugs?

What sort of noise are the people in the flat next door making? Can you close your windows to prevent the smell of smoke getting in?
  • Did you mean to say your neighbours smoke weed, i.e. drugs? Was it a typo because it doesn't make sense otherwise. If you have evidence of that (e.g. smell, discarded joints) you should inform the police.

I'm afraid I agree with the other posters, you sound like the neighbour from hell. On one side you have someone with a medical problem who, from the sounds of it, is at least getting a bit better. On the other side you have possibly unemployed tenants that you have made all sorts of bigoted assumptions about. It seems like you could make yourself a lot happier just by changing your attitude.
