            Ah ok, didn't realise that. Seems a specifically flawed ground though, it's like saying that you couldn't be booked for parking on a double yellow, as you couldn't pay to park there anyway!
 I guess as long as it keeps appellants happy, but what they should presumably be doing is ensuring that these companies act lawfully in the first place?0

            Nothing like the scenario you have posted 'double yellows' as I think you are thinking of real Council PCNs? A completely different animal - Council PCNs are issued under statute. Private scam PCNs are just 'scam' (fake) PCNs like any Nigerian phishing email. Of course it's not a 'flawed ground' of appeal to use the simple fact in contract law that a charge for a breach of contract can only compensate the claimant and put them back in the position they were in (i.e. they can only reclaim real loss).
 In spite of having won, you don't seem to see that this was never a fine at all and there is no 'acting lawfully' (or not) involved. This is contract law - they said you owed a silly amount, you said 'no' and POPLA agreed with you.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
