Hi, thanks again. No, it is where the appeal should be copied into, but I'm having trouble finding what I should paste in. Can you help?

What - you are trying to bung in an appeal to POPLA without finding out what wins and without having an appeal ready to upload?! Not sure why you were even on the POPLA website yet then. I refer you to the top thread again 'How to win at POPLA' and you just need to copy and adapt the APCOA Airport one of course.

The American cartoonist Scott Adams is quoted as saying "You can never underestimate the stupidity of the general public".

    It appears he was right.

I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.

So let's check the situation you are in:
    You received rejection
You researched and wrote your appeal based on templates linked to in newbie thread (and don't feel the need to check it here as you are confident you understand)
You found your POPLA number - not your PCN number . You were definitely given one (they don't always)
You are having problems copying and pasting your appeal into the box.

Can you confirm this is the case. If not tell us what you haven't done or what the problem is?
Newbie thread: go to the top of this page and find these words: Main site > MoneySavingExpert.com Forums > Household & Travel > Motoring > Parking Tickets, Fines & Parking. Click on words Parking Tickets, Fines & Parking. Newbie thread is the first post. Blue New Thread button is just above it to left.

Ok, thanks for the various replies!

Quite annoyed by bargepole's unnecessary response however, and it must be a comfort to be quite the expert, having dealt with similar situations over 30 times it appears. I too would, despite my apparent stupidity, be familiar with the process by then also!

For the avoidance of doubt, I am familiar with cutting and pasting, that is not the problem.

I didn't "write an appeal", I initially just used the one on the thread for the initial APCOA appeal. Now I can't find the "top thread" you refer to coupon-mad, sorry. You guys refer to "newbie threads" and "top threads", having perused and contributed to all of these frequently no doubt, but alas, I'm confused about which one is current and which one to use! Sorry if I'm being thick!

A link would be a great help!

The top thread is at the top of page one of threads. And my signature even tells you where to click if you don't know how to find the current threads. Once you see how easy it is to hop around the forum, read a thread then click (one click) to hop back to page one, you will wonder how you coped before!

Ok, thanks, coupon-mad. I've found it, the one started by you on 10-11-2013? - found it via the Forum Jump link.

In that thread though, the link to "Second Stage Appeal", which is the stage I'm at, takes me to a thread which doesn't seem very similar to my scenario, referring to parking in an area where a permit is required.

I was stopped on red lines at Birmingham Airport, so could someone please direct me or advise on how to progress with this please? I would probably just have paid the penalty, had I not did a quick Google search and found all this info on here, but there's so much to read and understand, perhaps I should just have paid it?!

The other reason why I'm annoyed enough to pursue it, is that the bloke who presumably took the picture of me parked "illegally", drove up alongside me and asked me to move, already having taken the picture. I moved straight away, after a brief conversation where he agreed that the short stay car parking prices were " a rip-off".

Were you looking at the links in post #3 of the sticky thread , the link called 'how to win at POPLA' and did you then click on the one about APCOA at an Airport? If that's not similar enough there's a recent one written v VCS at an Airport where the arguments are the same but you've have to change the name of the PPC to APCOA throughout and proof read it for relevance of course.

What you describe is typical and it's why our examples have a paragraph about the 'secret camera van' not being open ANPR camera recording.

    Ok, I'm getting into the swing of this now! I'm basically using the amended communication from OBAone a few posts earlier, but I have one specific query so far;

Point 6 - No evidence that APCOA Parking Limited has a contract with the landowner/occupier that entitles them to levy these charges.

Not sure if OBA had the same letter accompanying the original APCOA Notice, but I had a letter from Birmingham Airport attached, signed by David Winstanley, COO, basically stating such things as, "appointment by B'ham Airport of APCOA to undertake these enforcement actions...........", and "B'ham Airport give authorisation to APCOA to take legal action for recovery of unpaid PCN's.......", and a few other statements designed to clarify the agreement between them.

So, is point 6 valid in my case?

@warop1 - your case has started to really confuse the situation as this thread is that of OBAone. Yours needs splitting off from post #31 to form your own unique thread, then we can keep advice specific to you clear of OBA's, otherwise things can at best get messy, at worst, expensive.

I'll PM Crabman (Forum Guide) and ask that he splits this away.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
