    No worries. You just need to keep an eye out for it popping up as a new thread. Crabman is usually pretty speedy at doing them, but he does give it a new title, which won't be the same as this one, so keep your eyes peeled. :)

    Hi again, just checked to see if this has been re-started, but can't see it. I assume I should be looking in "Parking Fines,......", and will it be labelled as being started by me, or the moderator?

    I PM'd Crabman at 17.10 yesterday, but, checking his profile, his last visit to the forum was at 13.28 yesterday. Let's see if the weekend brings about a new thread from him.

    Normally Crabman PMs me back when he splits threads I've asked him to do; nothing as yet from him. From recollection the new thread goes under his name.

    For the moment, should you have anything desperately pressing for advice, continue here as it will all eventually be exported into the new thread pertaining to your case.

    Apologies for the delay, I was away over the weekend (co-incidentally much of it was spent at Birmingham Airport thanks to the incompetence of Lufthansa). 25 posts have been moved into a new thread.

    Crabman, you must see if you can sue them under EC261/2004 like I did Monarch over the Ash Cloud delay (but that's for a different forum!). I got my hotel bill paid eventually and compensation (rare for an Ash Cloud case) which added up to more than the flights cost! Took 18 months and using a solicitor from my house insurance policy though!

    Sorry to go off topic.

    Please start your own thread. It is difficult to give advice to 2 people in one thread.

    Before you do read thoroughly the Newbie thread at the top of the forum one page back. (Preferably several times). If you need further help, click the new thread button and ask your own questions.

    In the meanwhile do a forum search for APCOA as there are loads of threads on this.
    Newbie thread: go to the top of this page and find these words: Main site > MoneySavingExpert.com Forums > Household & Travel > Motoring > Parking Tickets, Fines & Parking. Click on words Parking Tickets, Fines & Parking. Newbie thread is the first post. Blue New Thread button is just above it to left.

    Just picking this back up having had the bones of it moved to a new thread - thanks Crabman,

    I'm basically using the amended communication from another thread for my POPLA appeal, but I have one specific query so far;

    Point 6 - No evidence that APCOA Parking Limited has a contract with the landowner/occupier that entitles them to levy these charges.

    Not sure if OBA had the same letter accompanying the original APCOA Notice, but I had a letter from Birmingham Airport attached, signed by David Winstanley, COO, basically stating such things as, "appointment by B'ham Airport of APCOA to undertake these enforcement actions...........", and "B'ham Airport give authorisation to APCOA to take legal action for recovery of unpaid PCN's.......", and a few other statements designed to clarify the agreement between them.

    So, is point 6 valid in my case?

    Always!

    Have you seen the unredacted contract between BHX and APCOA? That is what you need to be asking for. If they don't produce it, it will be to your advantage at POPLA.

    You must make them do the work to prove everything they are levelling at you has a full legitimacy. Don't do any work on their behalf, and certainly assume nothing without seeing the complete and unadulterated detail.
