EE/Orange/T-Mobile - Reclaim ALL price rises AND cancel contract re T&C change

    RC - my EE account number now is different to the Orange account number I had back in 2010 and on my letter, but other than upgrades and a Port to EE i have in effect been with EE since then, does that matter?
  • It's taken me a couple or three weeks to pick up on this off shoot of the first thread, but have now sent off the first email. Fingers crossed and thanks again. :)

    Dear Mr,

    Thank you for your email dated 10 August 2014, addressed to Olaf Swantee, Chief Executive Officer, EE. Olaf has asked me to reply and keep him updated on my outcome.

    I am sorry you are unhappy with the recent Price Increase. As a company we are committed to offering the best value for service which is why we have kept the increase to a minimum. The increase is a result of the rising costs to our business and is in line with the Retail Price Index (RPI), which is a measure of inflation.

    The Office for National Statistics published its official rate of RPI on the 25th March. The official measure of RPI for this period is 2.7%. We contacted customers between the 5th and the 14th April in order to give 30 days' notice of the effective date, which was 28th May.

    We are obliged, as are all UK operators, to abide by General Condition 9.6 of the Ofcom. This condition sets out what we must do if a change is of material detriment to a customer, which is to provide 30 days' notice and allow a customer to end their agreement free of charge. When the changes are not of material detriment, the customer does not have the right to end their agreement. In the case of this price increase, the change is not of material detriment to customers.

    The increase is in line with the Terms and Conditions of your contract specifically clause 7.1.4. As the increase is less than RPI should you wish to close the account early in accordance with clause 7.2.3.3 you would be subject to an early termination fee.

    Did you send this email Post 4?

    They've clearly sent you a generic price rise email from the prise rise forum, which is what they have done to the rest of us, yours just has more info about the price rise.

    You will need to follow up this email though, as you have not been referred to CISAS and will need to get this referral to undertake the next stage. something along the lines of...

    Dear Mr Swantee,

    thank you for your email of the XXX from Jim Phillips, however unfortunately you seem to have failed to address either of the points raised in my email of the 10th August 2014.

    I am aware that over recent months there have been a number of claims against EE regarding price rise increase, however on reading my original email, attached for ease of reference, you will note that the 2 points raised in my original email are not the questions to the answer you replied.

    I trust having the opportunity to review my original email you will accept agree to honour the requests laid out.

    Thanks to Mikmonken fro proof reading and some sensible suggestions.
  • I upgraded last month but they are charging me £5 a month more than the contract agreement. Technically this could be construed as an unnotified price rise. Can I pursue the penalty free exit I wonder?
    The contract was hand written (I have a copy ) so it looks like something has gone wrong with the transcription

    I'm not sure as the price rise was effective in May so the timescales don't stack up ie your upgrade was after the price rise. You could however phone up and complain? See where that gets you, and if that gets you know where scan in your letter a copy of your most recent bill send to ee exec office and ask them to explain.
