Please tell us the outcome and we can help if the PPC ever try a small claim if you lose this appeal. Have not heard of Link Parking being litigious and right now court is no more of a lottery than the IAS appeals seem to have descended into. Makes you wonder if the IAS are trying to get their 'win rate' up in favour of PPCs but...wait...they are meant to be independent!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Here's an update:
2 of the PCNs could not appealed because they pre-date Link Parking's membership of the IPC, so the IAS's online appeals process would not let me submit them. I contacted Link Parking that seeing as I had no mode of appeal, I considered the matter closed. Their reply was they do not and I have since received a solicitor's letter. What's my next step here?
I also received solicitor's letters for the cases I successfully submitted to IAS (currently in progress). I assume they should not have done this and I should complain to the IPC?
The DVLA would not give details of how my data was collected sadly.0 -
There may be another way to skin this rabbit. Do you own or rent a flat in this complex, if so what does your lease/AST say about parking? Have you contacted the managing agents?. Is there a [EMAIL="Residents'@'"]Residents' Association[/EMAIL]?You never know how far you can go until you go too far.0

Well if I were you I would reply individually to each of Gladstone's letters.
First ask them to clarify who exactly instructed them.
For tickets which were "out of time" according to POFA 2012: point this out to them, point out that you cannot be held liable as registered keeper, and tell them that you require them to cease and desist contacting you over this matter.
For tickets where you have been denied an appeal: point out to them that you have been denied Alternative Dispute Resolution, that this flies directly in the face of the government's wishes when POFA 2012 was introduced, and warn them that should they or their client be foolish enough to bring proceedings you will be sure to draw the court's attention to their unreasonable behaviour. Suggest to them that they prevail upon Link Parking to issue a PoPLA code, because PoPLA will hear appeals relating to companies which have since left the BPA.
For tickets where your IAS appeal is pending: point this out to them, point out that you are reporting Link Parking to the IPC for breaching the Code of Practice by pursuing a charge when an appeal is pending, and require Gladstone's to cease and desist contacting you concerning the charge.
If the Gladstones letters tell you to contact Poxburghe or some other debt collector, ignore that and write directly to Gladstones at Red Cow Yard in Knutsford. If Gladstones is willing to pimp out its name and letterhead to tawdry debt collectors then they deserve to take the fallout
And do report Link Parking to the IPC for the breach of the Code of Practice.
If I were you I would also complain to your MP that you have been denied an independent appeal, that access to an independent appeals service was one of the factors the government demanded in return for passing keeper liability in POFA 2012, and that DVLA has been, to say the least, sloppy in allowing a situation to arise where neither of the trade associations it has accredited is available for your appeal.Je suis Charlie.0 -
As regards DVLA, make it a complaint: tell them that you believe your details to have been misused (which they have), and demand to know who accessed them, when and how. If they refuse, escalate according to the DVLA complaints procedure until you reach your MP and the Parliamentary Ombudsman.

You can make a a Subject Access Request, for which DVLA will charge a fiver, but you shouldn't have to.Je suis Charlie.0 -
For the cases were pre IPC, if you appealed in time you have the right to go to POPLA. Were you offered this?
If not a complaint to Steve Clark at the BPA is on order.
For the cases that are IPC these are a breach of section 6 point 1010. The IAS endeavours to notify both parties of the outcome of any appeal within 28 days from the date of receipt the same. Whilst an appeal is being determined, any enforcement action shall be suspended
So yes a clear breach and a complaint should be sent to the IPC as well.

Yep complain to Steve Clark that an ex-BPA member has not offered a POPLA code (x 2) for the older PCNs, and you were refused access to the IAS as the PCNs pre-dated the IPC membership.
Look below, the BPA has stated this isn't allowed as long as the person appealed in time, they can have POPLA codes for PCNs dating from BPA membership:
