IJT Direct - Refusing refund, theft of parcel

This was the term:
Retention of Title
All ownership, title and risk of loss and/or damage in the goods purchased shall pass to you at the point and time at which the goods are allocated and/or charged to your card or account. The sale takes place in Jersey and is concluded in Jersey.
IJT Direct Limited retains title to all goods supplied until such time as they have been fully paid for.
How can they get away with this? Surely there must be loads of issues with this company?
Because our laws differ from the UK, in some areas they are stronger (for example the data protection act, smoking is banned in cars with children and (on a similar theme) there is a vote for smoking to be made illegal for anyone born post 2000). In other cases, such as this, the laws are weaker for the consumer.
The consumer laws are under review with an expectation to adopt the Uk latest 2013 law either this year or next.0 -
A question for you legally minded.
As the Company is based in Jersey but they are dispatching from Somerset, does this make any difference concerning their terms, as in how it would apply to the consumers act?
No, the laws are under the jurisdiction of the incorporated company (in this case Jersey).

Forging the neighbours signature is illegal if the reason for it is to deprive the rightful owners of their goods.
divepro, have you seen the alleged photograph of your neighbours door?
If not you or your neighnour should ask to see this as it's possible that the delivery was made to a totally different house to the one that DPD think it went to.
Yes, the photo was sent by email. It is the neighbors house in question. I showed this to the constable, however nothing came of it. She still said they would have no right to search his flat. In any case, I believe the printer is long gone now anyhow. It would be kind of foolish to keep it around.0 -
Just to clarify - My signature was not forged. The name signed for on the receipt of delivery (If this even happened), was not the neighbors real name. However the delivery driver positively identified this neighbor as the person who signed for it. Unfortunately the delivery driver did not return today at the police visit to confirm this, however I did hand his telephone number over to the police, but who knows if they will even call him?
The driver alleges he has reported the incident to his head office at DPD.0 -

Even though I specified, and I have proof (on email from DPD) that the delivery was to only take place on Monday when I was home?0 -
Unfortunately you only have a contract with IJT, IJT have the contract with the courier.0

Unfortunately you only have a contract with IJT, IJT have the contract with the courier.
Well I have written to IJT again, But I suspect I will not be refunded or have the item replaced. I guess my only recourse is a charge back on my mastercard - How annoying
I was hoping they would deal with this fairly. Last time I ever order something from there - too risky, and no recourse if something goes wrong. You would think a large company like that would go out of its way for its customers, considering I would have probably continued buying inks off them, to replace empty ones for the printer in the future!0 -
Just checked their registered address
Name: IJT DIRECT LIMITED
Registered Office: 3rd Floor 37 Esplanade St Helier Jersey JE2 3QA
amazing, they are literally next door to where I work, I can look into the 3rd floor offices from my deskDon't remember their name on the outside though as 37 Esplanade is a recent development with companies only going in during the last 6 months.

If you are not already on twitter you could join up and give them a public questioning why they think their policy is fair.
