PCN From LCP - Harefield

Hi Guys,
I've received a PCN from a company called LCP for not paying for parking (didn't realise i had to). I know the standard procedure is to appeal which i will be doing but before i do, i just want to confirm one thing.
The car is owned by a lease company (who's name are on the log book) but managed by another company who manage the work car fleet. LCP have contacted the lease company who have given the details of the management company as the Hirer. They have received a notice to Hirer (PCN) which they have forwarded to me to do as i wish with.

Now, from reading the incredibly helpful newbies thread, I'm drawn to one paragraph in particular
COMPANY, LEASE OR HIRE CARS ANYWHERE IN THE UK

In the case of a company car or hire car, the above advice differs. You would have to appeal EARLY to hook the PPC in your direction, before they get a chance to get the keeper's details from the DVLA or equivalent. You should also warn the owner/keeper (Fleet Manager) not to pay if they do get a letter about it because they have no business to get involved in a fake PCN you have already appealed as driver, and you won't reimburse them if they are daft enough to pay it.

If the hire/lease co has named you as the driver that is a good thing as it removes them from the loop entirely and then you can follow the above advice as appropriate to your case - but check and see if they have charged an admin fee. Challenge that admin fee with the Fleet Manager, Hire firm or your HR Manager, if your car use t&cs do not support this deduction for a mere invoice (as opposed to a fine/penalty).

Im my situation, they already have the details of the keeper (assuming this is the owner on the log book?) so how would i go about drawing their attention to me as being the driver? Im still well within the 28 day appeal period but i want to get it right first time round so in this situation, would a simple "i was the driver at the time you are suggesting a breach of your contract took place" do the job at the beginning of the appeal or am i going to have to fight harder here?

Thanks in advance!

I think since the lease company are registered keepers, the car fleet must be the keepers so you have to appeal as driver.
Other than that as per the newbie thread.

Even if not the same car park, it's the same PPC if your 'LCP' is London Car Parks':

    http://www.londoncarparks.co.uk/index.php

Read the threads in detail, especially post #52 onwards on lynneh's thread and any other LCP threads you can find on here or by Googling (you may have to include the word 'Plaza' with 'LCP' in the Google search even if your car park wasn't that one.

And by the way, the chaps at LCP (if yours is the same LCP?) will soon spot your thread as they seem to like trawling our forum - so get rid of dates and detail about who was driving - NOW.

    First post amended. Thanks :)
Funnily enough that has actually raised a good point. I never left my car as i was taking a friend to use the facilities in burger king. They left the car but i did not!

Yes it is the same LCP as you link above and yes it is Harlsden Plaza.
Ive taken the template and modified it lightly to my situation which. I know they will complain about it being a generic forum template but there is no law against doing so as far as I'm aware! Would i be ok to post that here for a quick check by you experts before i send it off?

Yes of course. And also send a pm to lynneh as she has got a lot of photos which will help, including a banner at the Burger King which states a different restriction there (no parking) than is on the signs - and the signs are also found wanting!

By remaining in the car it means 2 things. You are not parked, you are waiting. And waiting cars occupy no space. Neither does a car whose engine was left running. All good winning points at POPLA. :rotfl:

    Accepted !

In another thread this week I was commenting on the misconceptions that many OPs have about cars not being parked because they were still in the car or the engine was running when they were waiting and somehow that made the car invisible and occupying the ether not a parking space.

Doesn't make the swingeing charges any more valid, though.

Right I've read my appeal over again and really wasn't happy with it. Full of holes so I've just used the generic one in the newbies thread adapted to my situation. Lets see how i get on with them and what rubbish they spill me!
