    Every little helps though, now you can mention that and show them as evidence of unreasonableness and data protection breach!
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    Update time:
    The court set a hearing date for the end of August. I was expecting new requirements for exchange of witness statements, but that wasn't on the letter and no other communication has come. I was just thinking I need to get started on it regardless, when BOOM, a big envelope drops on the doorstep from Gladstones - it's their clients witness statement. Slightly panicked, I called the court this morning to check in case I've missed a letter with the info on, but no, I'm told I only need to have served my witness statement at least 14 days before the hearing date. Panic over! Phew!

    So I'm getting started on my WS now. Quite handy to have sequential service of WS as I requested really.

    Quick update:
    Had an email from Gladstones this morning, saying they have not received my evidence, and so cannot proceed to provide me their second witness statement.
    I've called the court again, to re-confirm with absolute clarity, that as this is now proceeding to a hearing, witness statements/evidence is indeed to be exchanged no less than 14 days before the hearing......YES, I am told, so that's clear then.
    So I've emailed Gladstones back to let them know that's what the situation is and the court has now confirmed this to me twice!

    I get the impression they still think this is a papers only case....

    Are they honestly suggesting that the sequence is you first then them? What does the order say?

    The original order for papers only hearing was to exchange witness statements end of June, but it said if you decline the papers only hearing, a new order will be made. The new order gave a hearing date but failed to state any date regarding exchange, so I asked the court, who advised 14 days before hearing date and also said it would have been helpful if that were stated on the latest order. As I said, I!!!8217;ve spoken to the court again today to reconfirm that!!!8217;s correct and have been advised it is, so they can wait now !!!55357;!!!56397;!!!55356;!!!57339;

    @ Daniel

    Please switch off your 'Smart Punctuation' on your iPhone/iPad to avoid posts with !!!!8820; and the like, as every apostrophe and some other punctuations convert to exclamation marks and numbers.

    It will remove anything similar from any future posts you make, but unfortunately copy and pastes of other people's inputs will still carry the fault and will need to be tidied manually.

    Go to 'Settings' > 'General' > 'Keyboard' > 'Smart Punctuation' and flick the switch off.

    Switching off seems to have no detrimental affect on any other use of the keyboard.
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
