They treat that as an impossible situation regardless of what the legislation actually says.
A licence is only is valid from the date it is taken out, not necessarily the 1st of the month - and not backdated to 1st if it is taken out later in the month.
A SORN declaration ceases to be in force on the same date, not 1st of that month.0 -

...seems to be a case of Broken Record here; no amount of you repeating yourself will change the fact that the DVLA computer system does not, and cannot, record the simultaneous events of SORN ending and VED commencing other than at the 1st of a month. The questions that get the best answers are the questions that give most detail....0 -

So it seems.
It's obvious then that the computer needs to be programmed to work in 365ths of a year rather than 12ths.
Shouldn't be a problem - but I'm sure that the gov.uk accountants would see that as 'losing' income.
The whole VED thing is a political con.0 -
ok so we have established that DVLA computer system is useless!
my question is what do i do?
Ive sent my evidence via 1st class post which consists of:
- Email notification confirming date & time of tax purchase
- photocopy of small slip which tax disc is attached to which also confirms time, date and vehicle reg and price payed!
all this is attached to a cover letter which says:Dear Sir/Madam
I write to you regarding a recent letter you sent out to
me regarding a fixed penalty fine for an untaxed vehicle on the road which was reported to you on 23:21 - 24/04/2014 on CL******* ROAD, MO*******.
I would like to dispute this claim as the vehicle was
taxed on this date and I was awaiting the tax disc to arrive to me via post.
Please find attached to this letter all supporting evidence which I have regarding this matter.
You can contact me regarding this matter via telephone:

Kind Regards.

Now thinking about it i should of quoted some legislation in here to help back my case but surely DVLA know the law right?
should i prepare anything else? i know the fine is only £171 but its the principal of not being in the wrong which is why i refuse to pay, but saying that i do not want the baliffs calling! and its taken 3 months for DVLA to get this far - how long before they open my letter?
kind regards
Mike

I thought you said the ticket was for not displaying a valid disc,
Which is a completely different offence to keeping an untaxed vehicle on the road? - which one is it?I want to go back to The Olden Days, when every single thing that I can think of was better.....
(except air quality and Medical Science)

That is what they quoted to me in the letter, the FPN was issued by my local constabulary and they have obviously not taken it further but they notified DVLA who im guessing have investigated something and come to this conclusion, and are now taking it further!!!
the point is that i have all the evidence to proove that the vehicle was taxed on that day and i just didnt have a valid tax disc on show at the time of the offence........
does that help?
regards.

The FPN would be for not displaying a licence - s.33, VERA 1994, which the police deal with not the DVLA.
The DVLA deal with not having a licence - s.29, VERA, 1994, they would know you had a licence and why they said no further action would be taken by them.
If a police FPN is not paid, or a request for a court hearing not made, in 28 days(?), then the amount is increased by 50% and recorded at court as an unpaid fine. Which may be what has happened, does the letter explain what the claim is for?0 -

Luckily i kept the FPN, But because im a new user - i cannot post links and so cant upload the image
all the FPN states is that i have been reported to my local DVLA office for the offence, doesnt have anywhere on it that requires payment for the FPN......
Does this help?
Regards.

Does it say 'Fixed Penalty Notice' on it anywhere? If not, it sounds more like just a form notifying you that the matter will be reported to the DVLA. They would then take any necessary action for not having a licence, or no action if you had one.
Does the letter say who it is from and what the claim is for?0
