Well done you. A copy of the decision and the name of the assessor would be useful. Could you copy it into Aaron Ardvaarks 'POPLA decisions' thread please.
Was it actually upheld on GPEOL grounds? Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Yes, it was upheld on GPEOL grounds, the Assessor didn't review the rest of the letter.
I will try and get all uploaded this evening, if not at some point this weekend.0 -
hi I just want to know my dad popped round was here for 5mins he got a ticket as was in wrong bay , but someone else was parked in my bay so he was unable to, the fine said to pay £60 within 14day £100 after then. I rung park direct uk straight away and explained that he couldt park in my bay as someone was parked there and they said he still had to pay the full amount and nothing they could do. I had a permit for my dad to put in but was no use. what can I do?? so he doesn't have to pay it.
please help..0 -
Hello sarahb87, welcome to MSE. We can definitely help you with this, but you need to do a couple of things first.
You do need to start a new thread of your own, as we work on the basis of 'one case, one thread' so advice doesn't become confused and/or we have a complete free for all with any number of random cases being tagged on.
Then, please read the NEWBIES sticky at the top of the forum index (one page back from here).
You do need to read and understand that sticky as you will have to do a bit of work to get rid of your (Dad's) problem. We will help and guide you, but won't be able to do it for you, so the more knowledge you gain about how to deal with this, the better you will handle it, and the more likely you will be successful.

An academic point now, but any such "evidence" sent by Park Direct should also have been sent to you, in order to give you a chance to rebut it. More dodgy dealings - no surprise there. It appears that Park Direct tried to send evidence arguing the point on GPEOL and it was still overturned.0 -
Sorry to dig up and old post jabgk
Can you tell me if the incident happened day time or night time? as in if any signs could be seen easily?
I suffered the same thing from these cowboys and I am preparing my fight.

His was in the dark and he hasn't been on the forum at all since 1st August.
Even if you can't say 'in the dark' in your case, it doesn't matter - the template appeals are standard and you ALWAYS say 'unclear signage' as one point. Obviously you just reword it to suit your situation, not saying who was driving or parked (so not 'my permit' or 'I never saw any signs'). You need to just read the newbies thread. POPLA appeals examples are linked in 'How to win at POPLA' a hyperlink in post #3 of that sticky thread. You need to look at the windscreen ticket versions (any PPC) and adapt one. Please do read the thread for NEWBIES in capitals at the top of the forum. If unsure stay on your OWN thread and shout for more help:

Hi
Would just like to share my success story as to my amazement after recieving a parking ticket for waiting for less than 5 minutes at 233 high street Uxbridge, I used points taken from the POOPLA appeal on this forum and various other threads and sent of my appeal to park direct fully expecting it to be rejected.
Today I received a reply from park direct stating after reviewing the appeal, the attendants photographs and the content of my letter they have decided on this is occasion to cancel the notice!
So massive thanks to the points brought up on this thread, as the content in my letter clearly worried the theiving crook's!
Good luck with anyone lodging an appeal, just shows it is always worth appealing, don't let them win!0 -
Just to add to this thread in case any Newbies try to copy the 'fairly' old wording of the above POPLA appeal, we have newer wording always being updated on page one of the forum so use the 'Forum Jump' and click 'GO' to get to page one!
PPCs cannot issue a drive-away PCN. Not allowed under their KADOE contract with the DVLA.

Great Popla template - I am just adapting it to mine now for my PCN from park direct in uxbridge.
Regarding paragraph 5- my initial penalty shows an 8 second gap between photos but the rejection letter photo's show a gap of around 18 minutes- can i still state the rest regarding 'grace period' or should I just delete the whole of that paragraph?
Many Thanks0
