Oh dear - lost at POPLA to ParkingEye - unheard of for anyone who knows about this forum and followed the advice here. You come here very late in the day but if you are prepared to do much better research for your court defence than you did for the wasted POPLA appeal (which we could have helped you win hands down and PE wouldn't have even bothered to send evidence to POPLA) then we'll help you.
It is not a fine but PE will indeed sue you now and will send lawyers to the hearing and you won't (as you can't reclaim the costs unless you have a house insurance policy with legal cover where they think you have decent prospects of success). What a sad sate of affairs. So unneeded.
But you have a LBCCC there - and we have a top sticky thread telling you how to respond to it as well (just as we had a sticky thread telling you how to win at POPLA). You need to read the sticky threads at the top of the forum and for now your priority is the LBCCC Fightback thread. At the top in Crabman's sticky threads.PRIVATE 'PCN'? Thank you all so much for your help/information.
Except Hot Bring and Nigelbb and Umkomass - was there any need to be so rude with your advice.
I read the information sent to me about POPLA and could see nowhere that it said mitigating circumstances would not be taken into consideration.
As for the other replies thank you very much I will try and find the other bits and pieces that you have mentioned.
Unfortunately when you get to my age and have never been a devious person just an honest hardworking person you believe that companies/people etc will treat you fairly and with some consideration. Alas I have found this is not the case.
My husband is very scared and worried now because from what everyone has replied he thinks we are going to have to pay well over the £100 - he is still working and he said this morning just ring and pay the £100 I don't want to pay somewhere in the region of £200 because of an error which it appears we made because we couldn't get the machine to accept our money.
So once again thank you for all the good advice given but it looks like ParkingEye will get our hard earned £100.
OAP's don't seem to have any rights at all.0 -
its nothing to do with being an OAP , they get anybody over school age and as this is private land its unregulated , same as if you trespass in Buckingham Palace you may be sued for trespassing , no matter what the circumstances
I am not far off being an OAP and have fought these tickets for younger family members and helped an OAP as well so please do not bring age into it as its not relevant and implies ageism, neither are bailiffs relevant either unless you did not pay up if you lost in court
far too many assumptions and falsehoods in your posts that doesnt help you come across very well (nor your username either)
I would always go to popla with a good defence and pay nothing , just do not use mitigation as your appeal in future because it clearly states on their website that mitigation is not accepted which you should have checked before submission
that newbies thread even contains the appeal template and links to popla appeals so its all been done for you if you get any more
here are the 3 main appeal points copied and pasted
appeal this using the info here for any popla appeals and you will pay nothing but it will take about 3 months to complete the process , but isnt difficult , if you start in good time and use the correct appeal points in future1) The amount being claimed is not a genuine pre-estimate of loss to your company or the landowner
2) Your signage does not comply with your ATA Code of Practice and was not sufficiently prominent to create any contract
3) You are not the landowner and do not have the standing to offer contracts nor to bring a claim for trespass
sadly these companies are not professional or compassionate, which is why they appeared on BBC WATCHDOG last week
just dont add to their coffers or they will keep sc*mming people , including OAP`s and the teenagers too , never mind those in between
if you have a good case , the judge will accept it and award you costs0 -
All you owe the PPC is the money which you saved from not paying the parking fee. If they take you to court for more then they are likely to lose. Popla does not do mitigation, but judges do, and if you were unable to get the machine to function then you have tried to pay but been unable so to do. Why should that cost you £100.
Unfortunately, the PPC do not see it that way. They think that anyone who loses at Popla is fair game. They think that you will make a cake of your defence, but just tell the judge the truth, that you tried to pay but the machine would not accept your money, probably because a coin was bent.
PE are not well regarded by judges and if it comes down to their word against yours, yours will invariably prevail.
Listen to the good people on here, do as they say and you can sting PE for £300 - £400 for their greed.You never know how far you can go until you go too far.0 -

Well I apologise if my flippant reply came across as rude - that was not the intention.
I don't wish to scare you but court is a lottery so be mindful of the chance you might get a foolish judge.
If your husband is scared and if the possibility that you might lose in court and have to pay around £185 could put you in financial hardship then you might want to consider making an offer to Parking Eye. They have been known to accept as low as £15. I didn't say it was because I was an OAP that I got the (parking invoice) - I merely meant it would be nice to be treated with a little more respect when you get to our age - I was always taught to treat others as you would wish to be treated yourself - obviously you do not agree.
I am sorry you found too many assumptions and falsehoods in my post, I am obviously not as well educated as you.
But I will say that I do intend to stand up for myself in front of a Judge, a bailiff or anybody else including you. Perhaps you should think about how your post comes across before criticising my actions or my age.
Some replies to my post have been what I term rude and have pointed this out. I have received an apology which I accept, I hope this had nothing to do with my age.
Also other people have helped by giving information and haven't found it necessary to be rude or flippant for which I am very grateful.

I do agree entirely , but your predicament has nothing to do with being an OAP so should not figure in your posts , makes no difference AT ALL what age you are and the parking company do not care about it at all so they will never do what you have asked for , neither will the other parking companies , they just want your money - end of , and will use all kinds of silly rules to get at it

irrelevant to this saga as you could easily have googled the answers and looked on here like I did last year and could and should have read the popla site a couple of months ago instead of now like I have already done last year prior to an appeal to popla that was successful. this had nothing to do with my "education" as that happened forty years ago , long before this private parking system got underway

good , although no bailiff will call if you abide by the judges verdict , so again this bailiff issue (that you brought up , not me) is again totally irrelevant

you do not do yourself any favours with the above rude comment because yet again it should not matter if you have a bus pass or not , or that you get the OAP pension , I certainly do not expect special favours as a non -OAP or as an OAP and neither should anyone else - but we should expect compassion and respect providing we dont abuse the fact at any age
your whole set of posts could have been worded better and should dwell more on the predicament you are in and what can be done about it , and less about age and expecting to get a free pass from the likes of PE , because if you came here everyday like I do you would have read cases far worse than yours , some about OAP,s and others about disabled people who could and should have been treated fairly under the law , yet havent been (myself included)
age does not come into it so I believe you created a rod for your own back by mentioning it and unfortunately that has deflected from helping you into a spat , which is regretful , but I stand by everything I said , good and bad , as you need a wake up call as court is not as simple as you think , I would find it daunting after spending a year on here researching the subject so I dont envy you and hope you get through this , despite your comments
