    There will be no mention of imprisonment until you ignore things as far as a court order to attend court.


    This will set out the possible penalty you face if you ignore it.


    Until then you can ignore everything without fear of imprisonment, though it won't help your cause!

    Question: if it goes court and i decide to go and agree on a plan. does anyone have an estimate of how much it would have to be.

    incomings: 18k

    outgoings: 1k debt, rent 300, commuting 300, childcare 250, mobile 12, general food 250.

    current debt: personal credit cards: 8k, owed money to people 9k, increases every month by 100 or 200 either on credit card or borrowed money

    what can they argue i do not have to pay for or i can pay less of and pay them instead?

    As you have been advised earlier in the thread, you would be better to try and agree a plan, then stick to it and not let it go to court.


    (You forcing them to court just will increase the debt)

    Why don't you pop along to your local citizens advice bureau for some free advice. There's a good chance they can make arrangements to freeze some of the interest so it does not keep going up each month.

    It may help you at court if you already have CAB involved helping with your finances.

    Be aware that if the "owed money to people" is informal loans from friends and family that a court may ignore this exists. If you formalise the loans the court will not normally ignore it. Again this is something CAB can help you with

    I'm going to be blunt. You are screwed.

    Your income can't cover your existing debts. The only spare money you have is the £12 for your mobile, and they are not going to accept £12/month as it would take more than the rest of your life to pay off. Furthermore the other debts you have, particularly the money you owe to "other people", are not going to count for much. They took you to court, they have priority, and they will push for as much as possible after your essentials like rent, childcare and food.

    Again, I'll be blunt. You have over-extended yourself with debt already, and this unexpected increase makes the situation impossible to manage. With only 18k coming in you won't be able to pay off the £34k + fees you now owe.

    This is called bankruptcy - when you can no longer realistically service your debts. Read the MSE page about it and seriously consider it. Otherwise things will just keep getting worse, with the debt mounting up. It's not as scary as it sounds, but you do need to work hard at it. I urge you to look into it because you should at least consider all options.

    What if i move out to live in saudi arabia? can they chase after the debt then? where will i have to declare myself to get it written off after 6 years etc? eg. electoral, banks, hm revenue,

    Don't you have to pay towards the debt for 12 months, something ridiculous as well?

    Is personal injury claims covered through this? i have read somewhere they are not.

    Also can you get car insurance if you declare bankrupcy?

    This may well be one of those debts for which bankruptcy will not provide relief.

    Normally on discharge from bankruptcy all the debts are wiped out. However this debt may fall within the scope of Section 281(5) of the Insolvency Act 1986. If it does the debt will not disappear on discharge.

    Good point. The OP would be slightly less screwed, but still basically screwed.

    After six years the bankruptcy comes off your file for most purposes, but you can get things like car insurance before then. The idea is that you come out the other side with a chance to move on.

    Moving to Saudi Arabia might help if you can stay there long enough, but it might not. You need to get proper legal advice on that. Realistically though could you move all your stuff there, or would you end up selling most of it? If the latter chances are most of the proceeds are going to go to the people you owe money to, unless you act fast.

    Chances are they you won't be able to offer them enough of a repayment plan to avoid them getting a judgement against you and taking your stuff in lieu of payment, and taking a cut of your wages.

    I have nothing other than clothes etc. nothing of value. if i move thats all that i will take with me. wanted to know where do i have to officially declare myself i have moved so they cant chase me.
