Police screw up. legal help please?

    Very grown up little man.

    The police are not scamming you and until you get that into the vacant space in your skull your not going to get far.

    No i didnt say that was what you were after did i? Im stating that when you put something on the forum you will get peoples opinions on it, like i gave mine. Therefore do not tell me whether or not to post something on here.

    Your a very foolish "man" and the police are not scamming you at all.

    I spoke to a solicitor under my legal expenses cover and unfortunately you will not be able to recover these costs

    Under the Road Traffic Regulation Act 1984, police have the power to charge costs for recovering abandoned vehicles.

    You can claim this cost from your Insurance policy but risk increased premiums and of course your Excess

    I would still write to the Chief Constable and to your MP and ask for a refund given that they did not ask you whether you wanted the car fingerprinted (which apparently some Police Forces do)

    Also Victim Support have argued that this it's rough justice and it effectively smacks of re-victimisation. and the Home Office has confirmed that it is reviewing the charges so a letter to the MP can do no harm.

    If the police are going to tow the car anywhere - whats wrong with dumping it outside your house? Then just charge you for the towing costs.
    Why does it have to be stored?

    some people may have the money to pay out £500 storage costs but the majority of the public do not & quite often the car is not worth that sort of money.

    No, because that would then be a civil case.

    In practice, of course, if you fail to pay the 105 pounds then you won't see your car again (technically, the garage will have taken a lien on your car for the amount you owe them.

    Basically, if you can afford to drive a car then you can afford to meet these little incidental costs. If you don't like them, then do what I do and get a bicycle, or just catch the bus.

    Surely the car is stored for security reasons.
    If a car has been stolen, chances are the window has been broken or there has been forced entry. The unless the car had been stolen with keys, the steering lock will be damaged. therefore it is not feasable to leave a car that has been stolen on the road-as it may be stolen again

    You have to wonder if it is only a matter of time before the police start charging for the return of other stolen goods. Seems like a nice little earner....Mr Plod recovers said stolen goods. Takes it back to the station and sticks it in the lock up. A few days later finds owner and gives him a call. Come and collect your items and please bring your cheque book or credit card, we charge £50/night for items recovered and held by us plus a one off £10 admin fee. Please park round the back of the station in our Pay-and-Display carpark (£5/hour, be warned there is a charge of £50 for not purchasing a parking ticket or your car may be towed away).

    Something similar applies if you lose property on public transport. However, the costs of retrieving and storing lost/stolen property and then paying someone to handle enquiries and check the identity of people seeking to recover their property all have to be paid for somehow.

    In the case of the Police I believe this charge is called Council Tax. Although it appears this only covers a variety of their services, other ones they sub-contract at our expense.
