You might have had a case for refund at 8 miles but 4000 is going to be very hard I'd imagine.
I didn't know that anything was wrong at 8 miles though. If I had known at that point, I would obviously have returned it straight away.

Wouldn't matter a monkeys. Certainly will matter even less over time.

I'm selling an mx5 at the minute and I've it advertised as one owner from new. V5 shows dealer owning it on day one, customer owns from day 2. Not an issue at all. Spoke to a bloke this evening about it and hecisnt even remotely concerned about whos name is on tax book first. He has arranged to come view it this saturday

Yes, that is correct. I have been doing some research online and apparently dodgy broker companies do this to get the best fleet discounts from the dealerships. They usually keep the log books for 3 to 6 months and claim that they have the vehicle in their possession in case they get audited by the dealership. I guess one option is to get in touch with the dealership and let them know that this 'fleet' company is probably breaching their terms and conditions?

The order form was emailed to me as a PDF. I signed it, scanned it and emailed it back to them.

    Well worth enquiring about.

...during all of which time, the car has been to all other intents and purposes "his". It's been in his possession and available solely for his use. The _only_ difference here is one of the details on the V5C.

And the fact that the OP's insurance may in fact have been invalid?

Unlikely, but - yes - possible. Even so, that's now a historic risk.

The small print on that document may over ride the website small print. So long as they don't say they can supply a substitute etc you may have a case.
My bet would be they have a loophole for this clever con. You may also find the car is an import, intended to be sold somewhere like Cyprus.

The car was supplied straight from a UK franchise dealer, according to the original post.

"They are now arranging for me to become the registered keeper," Not arranged, arranging, so as the op would have declared he is the owner and registered keeper, it's technically not insured.

In the meanwhile, a quick phone call to the insurer to make them aware...
