However they can still come up with the agreement at any time and start processing again. Thats my interpretation anyway.
Not true, and besides the contract in this thread is a phone contract, so a CCA does not even apply to this.Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB

What company is the default recorded as being from?
They are the people responsible for it's accuracy.Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB

exactly this is the company shown on my file, they obviously cant prove it and I am reporting them. now they say its not their responsibility.
how can i get to the bottom of this please? I am asking them who is responsible for putting that default on my credit file?0 -
it seems they have a get out clause by passing the buck, who is responsible for a default recorded on a file that is suspected to be wrong? how can I get to the one who is responsible?0

The company name on the entry on your file is the one responsible. Doesn't matter what excuses they make. Once it is in their name, they are the data controller responsible for updating or correcting the record.
So it's in the name of a debt collector now on your file?Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB

I have said this to them thankyou. They are trying to pass the buck, but it is the company who put the default on my file that I am dealing with. I thought they were the ones who say I owe them money, but now they are saying they represent someone else.
I am going round incircles.0 -
