Dispute a default on my experian credit file.

So what information has the creditor (or debt collector) sent to you regarding this debt?
Have they sent you a copy of the original contract/agreement? or copies of the outstanding invoices or what?
If this relates to a telephone contract have they informed you the phone number used on the account? and if so is that a number you recognise?
If it relates to another telecommunications supply (such as broadband) have they confirmed the supply address?
This is what Im asking for. So far they have not been able to provide anything.0 -

Its the telecommunications company I am dealing with.
I will write a written letter as well. But these days I thought electroic is better because you can prove it.
I have all correspondence they even said " I can advise you that the balance of the account relates to £61.07 of unpaid airtime debt and an Early Termination Fee of £927.14 as the contract was not paid or completed." Which makes me now certain that there has been some mistake I have no memory of this, I do not know what the explanation could be.
Maybe someone used my name or something?
The question is what to do now, its really affecting my life until I get it removed.0 -
A written letter should get to the right people and be taken seriously, emails far less so.
Plus for a formal complaint (that you could then take forward to the ICO etc) it needs to be in writing.
If it is not your debt then it could well be that the account belongs to someone with the same or similar name to you but has been incorrectly linked to you.
Key things to find out from them would therefore be the address the phone contract was taken out at and the date of birth given by the applicant. What happens if they mostly ignore you.
I get automated responses by email but they never provide proff, what is the next step please?0 -
Once you have sent a letter in the post headed up as a formal complaint and given them time to respond and if they fail to do so or fail to provide evidence of the debt and details of the account then I would make a formal complaint to ofcom and to the ICO.

So I have tried very hard to ask them to provide some proof, they are now ignoring me. I always get an automated email to prove receipt of my emails which is all good for my files.
My next step has to be the regulators. My next step is go ahead and make a formal complaint to ofcom and to the ICO.
I have the company who put the default on my credit file in writing and email that I will make a formal complaint to ofcom and to the ICO if you continue to ignor my requests to prove it.0 -
OK have sent everything off to ofcom.
I have also told the company I have reported them and once again asked them to please not ignore me any longer.0 -

You need to send CCA request to the company with a £1 postal order to get the signed agreement, if they cannot provide it within 30 days I think you can ask them to stop processing your data with the CRA's and remove it. However they can still come up with the agreement at any time and start processing again. Thats my interpretation anyway.-== CREDIT BUILD IN PROCESS 30% COMPLETE ==-
