Misleading, misrepresenting, inaccurate. Bullying could be used as its accurate, even exagerating. All words which could be used to describe these companies without risk IMHO. please correct if wrong.I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.0

In the case between Parking Eye Ltd and Somerfield Stores Ltd the presiding judge HHJ Hegarty QC found that Parking Eye was guilty of the tort of deceit and this was accepted by the Court of Appeal. Parking Eye have been found in court to be liars so describing Parking Eye as liars on a forum is an entirely factual statement backed up by the courts.
Perhaps PE could come on here (they obviously are following this) and confirm they no longer practise the tort of deceit? Then we can all be clear about this transformation. Seems quite an easy task to me.
There again, silence might suggest something else.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I know its hard to remain impartial with this subject, but if you think of it this way, the less the name calling etc the less the "parking companies" can harass MSE towers about them, and the less time MSE deals with them the more time and effort they have into resources for the site, and the less posts will be edited or disappear. I know people want to call them names that are factual but what does that really offer help to others than to relieve a personal opinion feeling about them, I see winning in various ways and giving ourselves a higher level of decorum is one less thing they have to complain to MSE about with less threads removed and less posts edited, that's a win right guys n gals?
I would really like to read a thread that's somewhat detached from personal feelings of the companies in question, I can get quite lost in a thread reading through feelings, it somewhat distracts me from finding the facts and upto date info.
It really would get them to have to sit and sulk knowing that MSE towers see's no issue with posts and threads and cant do nothing about the info being offered to beat them that's a win.0 -
Thing is when a company is unfairly (in their view) trying to take money off them then people get emotional over the matter. It's a rather large amount of money in comparison to the alleged 'crime' , it's in fact a penalty charge to punish people for making simple mistakes.
And I say 'mistakes' in brackets as we know that these companies use tactics that are designed to make these mistakes happen, their inability to prove a loss only highlights the fact that they have no cause to charge people the sums of money demanded!
I for one get p***ed off when we get these incidents happen on here daily, we are the tip the iceberg as this is happening at least 2.2m times a year, and upwards of 70% of the time it's paid. Liquidation is to good for these people. When this industry is fully investigated I hope multiple people serve time for the extortion racket that they run.When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.

Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

In 2012/13, PE's accounts showed a turnover of just over 14m. In that same period, they made over 800,000 data requests to DVLA. Assuming that around 5% of those returned no data (DVLA source), and using PE's own figure of an average of £64 per ticket paid, well ... you do the maths.
As has been suggested, don't get mad, get even.
I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. A lot less are being paid as a result of this forum, and that hurts them.
On top of this, land owners are slowly beginning to wake up and smell the coffee.

And I've got a copy of some BPA Council minutes somewhere (can't place them right now) where one of the meeting members said that only 1 in 3 people pay.
