Grant of Confirmation

I’ve submitted mine twice and had it rejected twice. There has been no mention of a fee to resubmit and in fact I’ve not paid anything yet. They said they would contact me for the fee when it is accepted as I’m not doing it in person. I assume all the Courts are the same but you could always phone and check. I’m submitting mine for the third time soon.0

i have just noticed that on the will my late father (the deceased) has typed his county wrong by one letter. Should I note this is the declaration or will it be ok? I already have this-Any Name son of said Any Name (deceased) and Executor Nominate conform to his will dated 4th November 2009 which is produced herewith, signed and docquetted as relative hereto. Any Name who was also appointed executor predeceased the said deceased.0

Although my grant of confirmation was issued, I made a mistake in an account number for one of the banks and was not accepted by that bank. I've therefore been advised I need to fill out a C4S or "EIK to Confirmation".
Unlike the C1, there is no guidance to go with the C4S.
Does anyone have a redacted example they could share as a starting point?
Many thanks0 -

Many thanksI cannot offer a redacted version of a C4(S) - but my understanding of completion in such a case is:
Page 1 and 2. Straightforward. Complete as per original C1 and confirmation etc.
Page 3.
- Top - executors name and address
- Para 1. Details of deceased to match information on original C1
- Para 2. insert the required detail from the confirmation document
- Para 3. Delete ‘Additional and’
- Para 4. complete/amend to read “That confirmation of the said estate in [insert whichever is appropriate for the item- ‘Scotland’ or ‘England and Wales’ or ‘Northern Ireland’] included in the said corrective inventory is now required in favour of me”.
- Bottom - sign and date
Page 4. Against Increases. list the correct description of the item, and under the appropriate country.
Page 5. Against Decreases. Wrongly described - and list here the incorrectly described item, and under the appropriate country - use precisely the same terms and description as in the original C1/confirmation.
Page 6.Straightforward
Insert values as appropriate on Pages 4,5 and 7.

Thanks to everone who has contributed to this thread and for the advice given. I recieved my confirmation yesterday. With regard to the house , I only had to put the address and did not need to give any description. This was at Kilmarnock where the staff member was very helpful.0

Hi all
I just wanted to say thank you to everyone on here, especially @GhibliFan, for all your help & advice. Confirmation for my late father's estate has now been granted and at considerably less cost than I was quoted by the law firm. I was fortunate to also have a very helpful person at the Sheriff court, who kindly looked over my application and suggested some minor changes before I submitted it. It's terrible there isn't more information and help readily available to allow people to complete this more easily at what is an extremely difficult and stressful time. The thread here is invaluable..!3 -
Hi All, my mum passed in July and her estate tips into a large estate made up of 2 bank accounts and some shares in a stokes and shares isa and fund/share account. There is a will and myself and brother are executors. I sent in the confirmation but it has been rejected, looking through this thread I see where I have gone wrong. I’m looking for confirmation on wording in the declaration and also how to layout the shares. I was going to use the below in the declaration
(my name and address) along with (my brothers name and new address) (previously residing old address) the executors nominate of the said deceased confirm to her Will dated xx which herewith exhibited, signed and docquette as relative hereto and that myself and the said (brothers name) are the daughter and son of the deceased.
how to lay out the shares, I’ve looked through here and other posts and don’t see any examples. Is this acceptable or do I need to put fund codes in too?
thanks in advance0 -
For para 2 you do not need to repeat your name and address, these should be at the top of the page. Here is a suggestion based on your entry:
That I am
along with [brother’s name] [brother’s address], the executors nominate of said deceased conform to her will dated [date] which is herewith exhibited, docquetted and signed as relative hereto, and that I am the daughter of the said deceased and the said [brother’s name] is the son of the said deceased. In said will, the said [brother’s name] is designed as residing at [insert will address], a former address.
It might improve understanding to incorporate words at the end of the fund descriptions such as ‘consisting of’
I would report the inventory totals within the 2nd column in line with the guidance in the C3.
Summary for confirmation
ESTATE IN SCOTLAND £ xxxx
ESTATE IN ENGLAND AND WALES £ xxxx
ESTATE IN NORTHERN IRELAND £ nil
TOTAL FOR CONFIRMATION £ xxxx
ESTATE ELSEWHERE £ nil
