Can I also confirm that box 25 should be nil if all the inheritance is being left to a spouse.  I have the Gross Value of the Estate (Box 23) which is equal to the total estate for confirmation.  In Box 24 I have then netted off the funeral expenses. But in Box 25 - Net qualifying value of Estate I have put 0, as all the estate has been left to my dad.  Just want to check this is correct.
Yes. If all passes to spouse (and children have renounced legal rights, if any) then NQV (box 25) will be zero.
Many thanks again buddy9.  I am just about ready to send it all off I think, so fingers crossed!
  • A couple of other questions before I send to the Sheriff Court:

In my inventory I have written the actual words:
Value at date of death including interest (for bank accounts/building society accounts etc)
    or
Valued at date of death (for shares/funds/investment trusts).

Having been going through this thread again, should this be the actual date each time eg. 11/08/23 rather than the words?

Similarly, to docquette the will I am planning to write:

Mytown 19/10/2023 (This is the date I will also sign the confirmation form)
This is the will referred to in my declaration of this date relative to the Inventory of the estate of the late (Mymum's full name).

Again should the words (of this date) be the actual date (19/10/2023) again.  I'm assuming not, as the date is written above, but just want to double check before I write anything.

One final slight concern is the numbering of pages.  In the notes from HMRC it stipulates that the continuation sheets should be for example numbered C2/1, C2/2, C2/3.  However, there is not room in the box to fill this numbering sequence in.  I note one of the example C1 forms on this thread has simply carried on and called the 1st continuation sheet 4.  I have 3 continuation sheets,  Can I just number them 4, 5 and 6, and thus the number going into the box in paragraph 5 would be 6. Hope that makes sense.

    Thanks in advance.

For the inventory entries the text ‘value at date of death’ is appropriate.

For the will docket the text ‘of this date’ is normal. Remember to sign the docket.

The C2 numbers can be manually written in or you could use the C1 version that contains additional inventory pages in sequence

Thank you for the information.  I didn't even realise this form existed.  I don't think I can cope with typing it all out again, however, so think I will take your advice and write the C2 numbers in manually.

Thanks so much for your answers.  I really appreciate you taking the time.
  • I have docquetted a minute of declinature using the formula “[Town] 31 July 2018. This is the will referred to in my declaration of this date relative to the inventory of the estate of the late XXX YYY ZZZ" (more or less as described elsewhere here), How, if possible, can I correct this error? I have tried to write the name above the line but the script is barely legible🙁.

I should add that I used ‘minute of declinature’ rather than ‘will’.

So you made a mistake on the docket of a minute of declaration. I am not sure what the mistake is.

Also what do you mean regarding "I have tried to write the name above the line but the script is barely legible" ?

I omitted the deceased’s middle name. I attempted to insert it above and between the first and last names but the writing is so small and cramped it collides with the the other script so as to render it almost illegible (what a mess!). Regrettably, the result is even less legible than this:

    Two suggestions:

    1. If this is a simple declinature letter signed by the declining executor, and that person is easily contactable, ask them to produce another declinature: or

    2. Strike through your docket entry, initial or sign it, and write out the docket anew.

  • I am so grateful to have found this forum group. I read through all the comments and made notes. I was then able to complete the C1 form for confirmation of my husband’s estate. I took the form to Paisley Sheriff Court on Tuesday. It was checked there and then and all was ok so I paid the fee. Grant of Confirmation and 5 certificates were ready for collection the next day. A special thanks to buddy 9 for sharing the knowledge. It gave me the confidence to do it myself rather than using a solicitor. I did it within 9 weeks.
