  • For the Inventory. If the estate owes a Pension say £400 and say British Gas owes the Estate £200 do they need listed as items on the inventory. I was reading a thread that had lots of examples, but none had any, but no discussion about it. It was a year old so I didn't want to bump it.

    The inventory is intended to be a full account of the estate.

    A refund of an overpayment on a gas account by the deceased would be listed in the inventory.

    An overpayment of a pension to be refunded to the pension provider would not be listed, but would be included in the calculation of liabilities in box 14.


  • I'm about to start confirmation for my dad. I've successfully completed one for my late mother in law last year. The C1 and the wills for both are very similar. House, bank accounts, etc. I have one complication. My dad is due to receive a significant inheritance from one of my late cousins in England. The probate on the estate is still in the application stage down there. Should I include this in the C1 or as he is deceased it will now fall to my brother and I. My late mum was the original benefactor from that will. So will my brother and I automatically become the benefactors or will it become part of my dad's estate?

    Generally, when someone dies while entitled to a legacy but the legacy has not been transferred, then the legacy is an asset of the estate that would be shown in the C1 inventory. So if your Dad was due an inheritance but it had not been paid at the time of his death, then this would be the case - and the inheritance would be part of his estate for distribution as per his will.

    However, you say that your Mother was the original beneficiary. If your Mother predeceased your cousin then Mother’s entitlement fails and entitlement then depends on the provisions in your cousin’s will.

    Ok how would I find that information. I know the address and the name(eg Jim Smith).

    In the papers of the deceased. Failing which the solicitor who dealt with the house (but note your other posts) or Registers of Scotland.
  • Hi, I’m filling in the C1 form for my recently deceased mum. I have had the form rejected twice from Hamilton Sheriff Court and while they have given some pointers I’m still struggling. Everything is being done through the post as I live in England. I seem to have got as far as the declaration which is causing problems. The first named executor was my dad who passed away in 2014 but is still named in the will. Both my name and address have changed from that in the will and my mum died at a different address than in the will. I have it seems to declare all these changes despite there being a letter to her solicitor changing my name and address stapled to the will. The declaration is getting very long and wont fit in the box. Is it acceptable to finish it of on a plain piece of paper and sign and date it. 
    Also on the first page where it asks for executors do I need to list my dad ( this hasn’t been picked up, only that he is omitted from the declaration)?
    Also mum had a bank account with Santander, when I look up the sort code it gives an address in England does this mean I need to list it has estate in England despite being opened in a branch in Scotland?

    Does the will appoint you executor along with your late dad - or are you a substitute executor?
