  • A couple of quick questions, hopefully will finish forms today.  My mum has two small spousal pensions resulting from the death.  Do they get entered in 11.2 on the C5.  They are not recorded on the C1.
    Secondly, the Legal Rights have not been discharged.  One has renounced the other has not replied.  Is it the total amount, ie a 1/3 of the net moveable estate that goes in Box 9 or just the amount that has not been renounced?

    I did contact HMRC helpline but they were not able to help.  Thanks in advance.

    Are the spousal pensions lump sums? If they are, and you didn't enter them on the inventory, then I would enter them in 11.2.
    In box 9 it is just the amount that has not been renounced that should be entered. (The amount going to your mother, see q12 and box D, should be calculated on the assumption the unrenounced legal rights are claimed in full. So just the legal rights in respect of the child who has not replied.)

    Then don't include them then. They should not appear anywhere on the forms. (They will count towards your mother's income.)
  • Just become a member of this group. Lots of useful information shared. Just had my submitted c1 returned as inventory needs some work ?   Have put everything I feel relevant and honest. Is any body able to perhaps send me an anonymous completed c1 so I can check mine off. Unfortunately starting to stress me out and I just recovering from a TIA. I want it over and done. Didn't seem too complicated but court won't give help for the large estate. 
  • Welcome @sonnyboy987, I have only just submitted my forms so cannot say for definite if mine are correct.  Did they give you any guidance on what was wrong.  Did you list the heritable and moveable property in each UK area and say none, if there wasn't any.  You need to follow the list as per C3 guidance. People on here are great, someone will send you a redacted copy.  There is so much info here which has been so helpful to me with my first dealings with Confirmation.  
  • Hi, yes seem to have listed everything in proper order. Did say I should put value in the 4th column rather than the 3rd column so maybe that's what I did wrong. Although they did say my declaration  was completly wrong. I think I wrote too much. ?

    All total sums should be in column 4, which if you are doing it online, will add the amounts automatically.  The third column is to show a value,  before you show how much belonged to the deceased.  For example, joint ownership... full value in column 3, the deceased's share in column 4.

    Re the declaration Box 2, there are several suggestions within this thread, the one I have a screenshot of is as follows:-
    'the Executor-nominate and (your relationship to the deceased) of the said deceased, conform to the Will dated and signed (date of Will) which is exhibited, docquetted and signed as relative herto: I confirm that I have never been married to or in a civil partnership with the said deceased'
    You also need to put any other Executor's name, address and relationship to the deceased, before the conform part.

    It seems that there are subtle differences in each Sheriff Court requirements, which doesn't help getting this system right.   I am sure someone will correct me, if anything I have said is wrong.  As I said, I have only just submitted the forms myself with help from contributors on here. 
  • Thank you Gilly billy_2 I will rewrite . and think I will just send it back in and see what happens. Yes maybe different sherrifs like it written a certain way. I may have written too much. But all the information is there.
