  • My wife has worked for Tesco for 21 years, she has been told that in order to be allowed to sell alchohol, she has to sit an exam, and a police check will be done. Is this allowed, or even lawful, just for the selling of alchohol.

It's not required by law, but there is training out there for it: http://www.plhonline.co.uk/staff-training-licensed-premises/

If Tesco insist on members of staff undertaking training, then your wife will have to do it. Or take up a role elsewhere in the store that doesn't involve serving alcohol.
  • Thanks GH, I am sure she is happy to do the training, but can Tesco insist on a CRB check which i believed only applies if you work with children or vulnerable adults, and is not a catch-all for any activtiy?

Most employers do a basic/standard criminal records (DBS) check.

Usually those working with children or vulnerable adults have a more thorough 'enhanced' or 'enhanced with list' DBS check, these two can only be requested for certain roles.

Not so. The law has changed to prevent many of the checks that might have previously been carried out. Most jobs are not now eligible for a DBS check, although at least one company has sneakily got around the current system in England.

OK, so basically if you role isn't listed as eligible for a check, they can't do one full-stop?

My knowledge is from 3 or so years ago, when I was under the axe of redundancy. All applications I made stated they would carry out a criminal records check, and left a space to list disclosure of non-spent convictions.

Yes, that is as I understand it. Of course you still need to declare unspent stuff if they ask you, but an employer's ability to carry out checks seems to have been curtailed, listed jobs excepted. I bet there are ways around it though, apart from the one used by Morrisons.

she only needs to sit the exam , and have a police check IF she is applying for a personal alcohol licence, they are possibly talking her into this , in case the regestered licence holder walks out or is sacked , and they will immediately nominate her to the council.

holding a licence has good points , possible better wage , signing passport forms (nice cash earner!) BUT if you are brought into court , even for a minor offence, you have to declare you are a licence holder (understand the law) and will be treated to a tougher time

It also makes her jointly responsible if someone doesn't follow the procedures and gets caught selling to a minor if she is the license holder.
