Parcelforce.. missing wedding dress and forged signature advice please

Not true. Ebay's own silly rules do not override the law! Parcelforce have already admitted the driver left it unattended in an unsecured location, so the seller will be able to make a claim with them in the same way as if the item was lost with no signature. If the seller can claim for the missing item, then why on earth would they not do the right thing and refund the purchaser?
I do hope that you are right, she seemed like a nice seller, im just so gutted as this dress cant be replaced to be so much money out of pocket as well really rubs salt in the wound0 -
Was it visibly marked as " fragile wedding dress" then?0

The seller is the one who needs to claim from Parcelforce. It appears that they have already admitted liability. All Travelchick has to do is fully explain the situation to the seller and ask them to claim from Parcelforce then pass that refund on.0

In an ideal world they should refund but can you imagine if that happens every time. Thousands of sellers sending parcels which get signed for and all it would take is for the buyer to say 'I didn't sign, it may be my name but it wasn't me' and the sellers would have to refund. That's never going to happen in reality.
In this case Parcelforce are well out of order but imagine you had sold something, obtained a signature in your buyers name, then someone you don't know from Adam gets in touch and says they don't have the item in spite of you having a signature. Are you going to say 'oh Dear, never mind, here's a refund'. Of course you are not.
Parcelforce have told the OP that the driver signed, bet its a different story if the sender tries to claim.
I agree, Im sure that there are thousands of people every day trying it on, I am lucky this driver was honest enough to admit his error, the reason I came on here is so I know where I stand should the buyer have the attitude of well I have a signature, I have not actually emailed them saying I want my money back, I have emailed them and explained what has happened and asked if they could call me or pass on their number so that i can work with them to make sure that parcel force refund one of us, so that we both get our money back,
I dont feel either of us should be out of pocket and I have told them I am happy to do the calling and shouting around that needs doing to get the value of the item returned so that they are not inconvenienced however I do need to get my money back. and I came on here to find out my rights not to be judged or be put in a box with people that fraudulently swindle others every day!0 -

Pacelforce have already confirmed to the buyer what has happened, it would only take the seller a quick phone call to verify that.0 -

I will call parcel force tomorrow and ask who the seller can speak to, that may confirm to them I'm not just blabbing it :-)

Just thinking and I hope this can all be sorted out for you OP. So ParcelForce for the sake of argument refund the cost of the dress and OP gets that.
Original seller gets nothing - no dress and no money. How will that work. Will Parcel Force have to pay twice, once to cover the refund and then again to recompense seller for a dress that they no longer have?

No, the seller refunds the OP, and Parcelforce refund the cost to the seller. Seller ends up with cost of the dress, OP ends up in the same position as before the sale was made, and Parcelforce end up the cost of the dress downOne important thing to remember is that when you get to the end of this sentence, you'll realise it's just my sig.0
