Why wait for the postal NTK and why not admit who the driver was?

    But how can they legally not send NTK? This is very wrong, no? Because its residential parking area they might well assume its the owners park their car there, but again, I know people parking rented vehicles there. Just to be on the safe side, I will send appeal as suggested on 25 (27th) day. However, they say they will unswear within a 14 day period. By the way, when I Googled this few days ago, I have seen similar case: initial ticket issued with incorrect details, no NTK, happy owner, but few month later dept collectors asking for 140 quid.

    This is the ticket and I will post their sign later today.

    'Breach' and 'Failed to Comply' written loud and proud on NtD. GPEOL will see this off at POPLA.

    Follow C-m's advice above to, hopefully, wheedle out your POPLA code, then it's follow the NEWBIES sticky, drafting up your POPLA appeal, flash it up here for a look over and any fine tuning advice.

    "no need to dig any deeper unless your PCN was from 'Devere', 'District Enforcement', 'Secure a Space', 'Napier', 'CPM' or 'Combined Parking Solutions' - if so, please start a thread with a picture of the sign on site and don't respond to private messages offering 'help'!"

    So, why they are so different from others?

    Devere has a local judge in their pocket.
    Napier owns much of the land that the car parks they "manage" sit on.
    Combined Parking Solutions has a particularly nasty and vile member of staff ( ex-director ) who will do anything he can, is some cases illegally, to get money from the driver.

  • There is something to be said for appealing straight away as the driver and getting a POPLA code issued. I appealed as keeper and have had to complain to the DVLA & BPA numerous times and still haven't got a POPLA code.

    Some companies use this tactic to delay it further & get debt collectors involved.

    If the driver & registered keeper are one & the same there is no enormous advantage in waiting for the NTK. There is the argument that it gives the PPC extra rope with which to hang themselves & screw up the issue of the NTK in some way (out of time etc).

    I seem to recall that's what they do, then to drag it back to POPLA stage you'd have to complain to the BPA and faff about, whilst still getting debt collector drivel and the PPC saying (wrongly) that you are 'too late to appeal'. That's the reason I added them to the NEWBIES thread as one to appeal early, because there was at least one thread where the poster had practically lost the will to live with all the complaints & replies insisting on POPLA but not getting it. The BPA aren't on the consumers' side so they sometimes send rubbish responses to complaints.

    Search the forum for 'Secure-a-Space' and you should find a few threads.

    Yes it's wrong - but appealing earlier avoids the hassle & delay, gets a POPLA appeal code earlier and you'll win anyway! Don't appeal as 'the driver' though - no need to change the template as the keeper's position is strongest due to the POFA 2012.
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
