trethowans solicitors letter

I have tried to follow threads on these but am unclear what to do. My husband is registered keeper of a car but was not driving at the time & can prove it by way of his clock card at work. Have had a letter from trethowans threatening court action for 'condition1 'vehicle not wholly in marked parking bay in restricted area (eg on double yellow or red line)' & saying its a Breach of Contract notice, so not entirely clear what the actual offence is. The person driving the car followed an ambulance into aintree hospital. The relative in the ambulance had a heart attack & they were unsure whether she would live or die. The person driving couldnt find a parking space and so left it on the end of the bays in a lined area (but with a blue badge in the window). Should they appeal to the hospital? Thanks

If it's not from a local authority (which it probably isn't), then it's not enforceable for a whole host of reasons.
Have a look at the threads in this forum : http://forums.moneysavingexpert.com/forumdisplay.php?f=163 and then start your own with the details mentioned, and you'll get help.0 -
I will ask for this to be moved to the parking tickets section. Be aware that Aintree regularly take people to court over parking.0
-
In the meantime can you say what communication you have had so far, with dates if possible.
To hold a Registered Keeper liable for charges strict rules have to be obeyed, I suspect that Aintree don't adhere to the strict timetable needed for this.
That means they can only chase the driver for money and that might be difficult if they don't know who it is.0 -
Hi. Ticket was issued on 25/2/14 and solicitors letter came on Sat dated 16th April. Appreciate any help you can give thanks0

Give out the details of the driver and let them invoice someone else"Dream World" by The B Sharps....describes a lot of the posts in the Loans and Mortgage sections !!!0

We dont want to grass the driver up unless we really have to. Would the 'fine' got back to the initial £300
-
Either fight the invoice yourself or "grass" up the driver, it was your car they borrowed after all....if they went through a speeding camera would you take the points and fine instead of them?
This one isn't a fine, its an invoice though.
You could appeal to the hospital due to the circumstances, if not already done so."Dream World" by The B Sharps....describes a lot of the posts in the Loans and Mortgage sections !!!0 -
You should appeal to the hospital, it won't do any harm.
Does any of the paperwork mention Protection of Freedom Act (POFA) on it?0 -
no. no mention of pofa. it does say that if he wasnt the driver we should pass this paperwork on to the driver then tell them who it is.0

I've moved this to the Parking sub-board0
