Agreed. If defended properly I fail to see how a Judge could find a keeper liable in this instance seeing as there is no semblance of a NTK, so POFA 2012 'keeper liability' simply isn't an option for them.

Anyway that's why I wrote that the OP should reply in mega assertive mode, threatening Trethowans with a complaint to the SRA. A Solicitor can't allege a law applies when they know full well (due to their own failure of documentation) that it doesn't, then have the cheek to ask the appellant where they may have failed!

Well yes but that's not to do with your case and you need to respond as I have told you to do - they have no case against a keeper - you need to explain why and get really assertive about reporting them to the SRA over citing a law they haven't complied with - it's misleading to say the least.

Fortunately I remember Trethowans when they operated out of what were quite modest offices in the city centre of Southampton on the opposite side of London Road from where they are now. I note, looking at their partners, that there are some who will recall those days and their far more humble beginnings.

It was only 16 months ago - and well after the passing into law of POFA - that on their website Trethowans continued to describe PCN's as Penalty Charge Notices. With that in mind one might want to reflect on on sharp their service really might be.
