    Hi its FireOpal just to update you. It is 2 days since the first solicitors letter and I have just received a second solicitors letter offering the full amount plus interest plus court fee £359

    Hi all i had that exact letter but also a letter saying they would pay on same day. Dont worry they just trying to scare you!

    Lloyds sent me a letter last week settling out of court but as one of the conditions asked me arrange one of these review meetings. I can't help but laugh at the wording of it, if we play them at their own game technically i could arrange the meeting and not attend it (they don't mention actually going to it!). Lol.:rotfl:

    i had the same letter and then a day later i received a letter from their solicitors agreeing to pay up in full! yippee! ignore it and wait for the letter or the courts!

    Hi everyone, I am currently taking Lloyds TSB to court to reclaim £178 of bank charges.

    Today I received a letter from their solicitors stating that they will defend the proceedings and that "Looking ahead, a situation which gives rise to a dispute is not one the Bank wishes to continue." and they have asked me to contract the branch manager within 14 days to review my current banking arrangements.

    I presume that they are going to close the account. The problem is that I have a £700 overdraft (up to the limit). Taking off the bank charges (if they repay them) still leaves £500, which I can't afford to clear.

    Will they demand that I pay it off?, and are they within their rights to do this?

    Any help appreciated. Thanks.

    They shouldn't take the overdraft of you especially if you pay a service fee for it. Don't forget to add your interest on ;) No bank can defend the claim and they are just trying to get you to accept a lower offer.

    If they do threaten you with the remove of your overdraft, threaten them back with taking it to the Financial Ombudsman as they will charge them £400 per complaint (apparently) and it will may make them think twice about doing it to you ;)

    I get the impression that when banks do close peoples accounts they do it swiftly and hide behind a letter rather than do it face to face (to cowardly for that).
    I wouldn't be shocked if they try and switch your overdraft to a loan though, so be prepared.

    Hi Artlaw, I don't want to build up your hopes but:-
    A review doesn't mean they will close your account.
    SC&M have been sending out 2 letters recently, 1 very much as you've described, and the other is full settlement to your claim. Sometimes these arrive together!!

    SC&M are sending 2 letters out at once (i've had both) but sorry to say they both state that you have to go for a review of your account!
    Like i said though, banks are to cowardly to tell you to your face they are closing your account, besides they wouldn't put their employees is that sort of position, can you imagine the sort of hot water they could land themselves in if people start getting nasty to the employee thats telling them about an account closure, they'd end up in court against said employee!!!
    Also if you think about it, part of the reason they have no one turn up to anyones court cases so far is because they didn't want to put a face to the problem, don't see how this would be any different!
