Ive Had A Letter Today Off Lloyds Tsb Solicitors Saying The Bank Will Be Defending On The Following Grounds, The Fees Are Properly Incorporated Into My Contract With The Bank And By Making Payments By Cheque, Debit Card Etc And Going Over The Overdraft There Are Penalties As Im In Breach Of Contract, And They Are Asking Me To Make An Appointment With My Local Tsb Within The Next 14 Days To Reveiw My Account And They Await Confirmation That This Action As Been Taken...as Anybody Else Had This Letter, What Do You Think...

It seems to be Lloyds TSB's new solicitor's defence letter.
I just wonder what they mean by "reviewing the account", though. I cannot imagine that it is a threat to close it, as this would not go down well with a judge.
The account is clearly under dispute, so they cannot do anything to is as a result of that dispute.The acquisition of wealth is no longer the driving force in my life.

Ive had so called reviews with Yorkshire Bank for the last few years.
Basically you went in they had a quick look at your account, asked you questions about your cards, loans mortgage etc.
Its all based on getting you in and getting you to sign up to there products.
I hate these reviews, I find the questions intrusive and the advice is biased on the basis that they want you to sign up with there products rather than shop around for the best deal.
So one year got the letter for my annual review, ignored it and bearing in mind that allthough my account was slightly overdrawn at the time it was well within its limit and there was no dispute between me and my bank about anything (unlike now), they called in my overdraft without warning.
I know at least one other person this has happened to with there bank, id go for the review but take a 'witness' with you incase anything they say could be of interest to the judge.0 -

I wouldnt bother doing anything. To me this is just another delaying tactic the banks have adopted, its not a rude one but it certainly isnt helpful. You havent asked for a loan or anything like, in simple you want your charges back. Personally I would ignore it & carry on the process, alternatively you can say you have no wish to discuss your current account status until your original complaint has been dealt with in FULL

The Bank will be defending these proceedings on the following grounds:
1. The fees that you seek are properly incorporated into your contract with the Bank;and
2. By making payments(whether by cheque,debit card or any other means) from your account where you have insufficient funds to cover them, you are making a request to the bank for an increased overdraft, which the Bank may meet or decline. If it meets your request, you must pay the necessary charges. The issue of penalties only arises as a matter of law, where there has been a breach of contract and there is not breach of contract here.
Looking ahead, a situation which gives rise to a dispute is not one the Bank wishes to continue. In view of this, you are requested, please, to make contact within the next 14 days withl your local Lloyds TSB Branch Manager, on 0845 3000 000, to review your account. A review may be useful to consider whether your current banking arrangements are the most appropriate for your needs.0 -

Hi thats one of Lloyds/SCAMs standard letters. They seem to be asking many people now to make an appointment. I wouldn't worry about it, you're well within your rights to be claiming your recharges they just try and fob you off and stall you in the process.
They cannot close your account on the basis of you reclaiming if they do you are well within your rights to make a complaint to the Financial Ombudsman of which they will pay will compensation for.

Merged these two threads as the content of the letter from the solicitor is similar.
I have read a post somewhere about a user who made an appointment with the manager who phoned through and negotiated a settlement for their claim there and then.0 -

If I was you I would just ignore it, Im sure the judge would see it as a blatant tactic to stall on the banks part. Unless the judge says you do sumart then you dont have to

Hey jonvic71, hang in there. Bet you get another letter today or soon with a full settlement offer but with their terms attached which you can ignore.
They have been sending these letters out together on loads of claims.;)0
