    I have received the same letter and I shall ignore it and see what happens as it seems as if it is a standard letter.

    Is this a standard letter and do I reply?
    .......The Bank will be defending these proceedings on the following grounds:

    1. The fees that you seek are properly incorporated into your contract with the Bank; and

    2. By making payments (whether by cheque, debit card or any other means) from your account where you have insufficient funds to cover them, you are making a request to the Bank for an increased overdraft, which the Bank may meet or decline. If it meets your request, you must pay the necessary charges. The issue of penalties only arise as a matter of law, where there has been a breach of contract, and there is no such contact here.

    Looking ahead, a situation which gives rise to a dispute is not one the Bank wishes to continue. In view of this, you are requested, please, to make contact within the next 14 days with your local Lloyds TSB Branch Manager<number> to review your account. A review may be useful to consider whether your current banking arrangements are the most appropriate for your needs.

    We wait confirmation from the Bank that this action has been taken.
    Also do I have no grounds to fight this case seeing as "The issue of penalties only arise as a matter of law, where there has been a breach of contract, and there is no such contact here."?</number>

    They received my letter a while ago and I have already started proceedings, this is their defence letter? Do I phone the bank and see what they got to say?
  • I think this is a standard letter. my son received this letter and an offer letter the same day so hang on in there. Lloyds had said they were going to defend but didn't.

    I may give them a ring, the bank may offer me something, will it hurt my claim if I do not ring them?

    As you can see by the above posts most people have had their claim settled by Lloyds shortly after receiving this letter.

    Hi folks,
    Just a quick update. My wife has just recieved an offer to settle in full out of court. Thanks for the support and advice from everyone. :beer:

    (keep going those who haven't got there yet or are thinking about claiming...):D
    My £2 savings total for 2007 = £92, for 2008 = £124
    My savings from money off coupons for 2007 = £67.97, for 2008 = £194.79
    My £2 savings for 2009 (so far) = £130
    My savings from money off coupons for 2009 = £593.08

    I today received a letter direct from the solicitors dealing with my case regarding reclaiming bank charges. They said that they intend to defend the case ( i already know this).
    Quote 'looking ahead a situation which gives rise to a dispute is not one the bank wishes to continue (in other words it costs them money), in view of this you are requested to contact the local branch manager for a review of your account'. I don't want to do this as I know they will try to sell me a loan etc etc. Will this affect my case if I dont arrange a review, anybody else had this type of letter?:mad:
