When did you buy your property? If it was 2013, you'd be eligible, if it was pre 1st December 2003 it's not eligible.
It does say that on the information given by MSE. Stamp duty land tax started 1st December 2003 so it's between that date and 6th April 2013.

THANK YOU !!! to the MSE team, and Martin Lewis. Saw this thread just before the deadline, made several calls to solicitor from 7 years ago, and eventually got the info needed. Sent two letters to tax office and cheque arrived this afternoon. What a shame all the legal people/estate agents etc do not alert us at the time, but nevertheless I am eternally grateful for the information. Again! x0

Thank you Thank you Thank you!! We have just received a letter to say we will receive a cheque of £1475 plus interest on the stamp duty we overpaid in Dec 2003 - just scraped into the scheme, originally had an awful thought we'd completed in Nov 2003 and wouldn't qualify - woohoo!!!0

Also received a cheque for £1,605 in the post from HMRC yesterday

So grateful for you highlighting this. Followed your links to HMRC and found out we bought in a disadvantaged area AND paid £1,350 stamp duty in 2004. Solicitor now retired so no help there. Wrote to the Birmingham address given, they asked for a copy of the TR5 form from land registry which was easy to get for fee of £7, (very helpful lady in Durham land registry office). Sent this to Birmingham and hey presto - letter today saying cheque for £1350 + interest is on its way. :j

Hi there, after being asked for several pieces of evidence by HMRC, and spending £21 on those from Land Registry and associated mail costsand time I have received a letter stating the following:
'...return filed in 2005 to notify HMRC about above transaction notified the 50% share that you purchased. Under Stamp Duty Land Tax legislation there is a strict one year time limit to amend the return filed if you wished to make a market value election'.
'As a market value election was not made within this time limitz SDLT is payable on the 50% share you purchased'.
'I can also confirm that for shared ownership lease transactions which completed prior to 12 March 2008, if the annual rent exceeded £600 per annum then 1% of the premium paid was payable in SDLT and Disadvantaged Area Relief could not be claimed'.
'A refund is therefore not applicable on this transaction'.
One, they have wasted my time and money, however if I have understood this confusing response correctly it conflicts with other responses on this forum. I don't believe that HMRCs response is correct. The rent value on shared ownership is confusing, £600 for a year? Has anyone else had this response?
