That is terrible! Why advertise that it is possible to get a refund and then refuse? Disgraceful!

They haven't refused, just keep on claiming they need more information even though every single piece of information is in what I've sent already but it isn't exactly the paperwork they want.
They won't even say exactly what they want proof of so I know it's just prevaricating when they're repeating requests for bits of paper that have the same information on them as other bits of paper I've sent already.
They appear to have lost some of it too.
I'm clearly going to have to send every single item I've already sent them again in one pack and basically include the entire file contents from the solicitor as I don't think their processes can cope with disjointed correspondence.0 -
Well, at least it's not an outright refusal. I guess it is an unusual situation so they want to be sure they are right in refunding...
It does seems that you would be better off sending in everything again to be sure.
I really think I'll have no chance now as the hoops you're jumping through are more likely to be stumbling blocks as I don't have all the information and the solicitor destroyed theirs so no hope there either. ��0 -
I can't think where else you could find out the right information if the Solicitors have destroyed it
There's only the land registry if you haven't already tried them. It might have some record that might just be enough. Or your MP could wade in perhaps?0 -
Well, I haven't heard anything at all so haven't even had the standard send more info letter. I have written again to remind them so we'll see.
It's just a bit annoying to not know what to do. I will contact land registry if they want more info as that seems to be my only option. I just don't have the transaction number and no way of getting it unfortunately!0 -
I rang them today to ask if they had received my additional information within the 30 day timescale and if the documents I had sent were the correct ones.
She said that they do not note the computer system when they receive documents so could not say if received. Also said that they had received far more requests for refunds that they had anticipated and could only suggest calling back every week.
So, we wait and see.0 -

Cheque received this morning. £1489.81.... property purchased in June 2011 so more than 2 years ago for those having problems.

Not sure if I have posted this correctly but I have received another letter today confirming that because my purchase took place before Dec 2003 I paid stamp duty and not stamp duty land tax and as a result I am not entitled to the money back due to a 2 year time limit in claiming.
This is the second letter I have received so think in my case I can't reclaim the stamp duty despite my property being in a disadvantaged area.

I sent a follow up letter but had a similar response again - the reason they are stating for the 2 year reclaim period is due to the fact that my purchase happened pre Dec 2013 so tax paid was stamp duty and not stamp duty land tax - this is apparently why the 2 year claim period exists.
Would be interested to hear if your purchase was also pre Dec 2013?0
