UKCPS LTD FINE. No Ticket No NTK but £100 demand?!!?

    Reading through your thread made me wonder whether the new letter you reported receiving in post#14 is definitely for a different parking charge than the first one you originally posted about.

    So apologies if this is a daft question but is the second letter you received definitely for a different PCN number or could they perhaps be continuing to process the first charge that they actually cancelled?

    yes i got a 2nd charge (different). the first was resolved by using the NTK response templates in the stickies.

    This 2nd one didnt work and i received an increased charge after i sent my first letter (for the new/2nd charge)

    Right lets get this down properly.

    So..

    First PCN 04/03/14

    - Nothing on the window of the vehicle.
    - Received NTK on 04/03/14
    - Sent 3 bullet point template from sticky within 28 days
    - PCN CANCELLED 08/05/2014 - Gesture of goodwill/1st time etc etc

    Second PCN 26/03/14

    - Nothing on the window of the vehicle.
    - Received a "Notification Letter" - it is not titled NTK and this time had 14 days to reply rather than 28 from the first PCN's NTK.
    - Sent 3 bullet point template from sticky with 14 days
    - Received a new letter on 13/06/2014. This contained an increase fee from £100 to £125. Telling me amount to be paid in FULL within next 7 days and failure to comply with this final offer, it may result in court proceedings which could exceed £325. So seems like a final notice before court proceedings (as said first line in the letter i have)

    I hope that makes more sense now.

    OK so that's a Letter before Claim - and UKCPS do court so be aware of that fact and don't let the ball stay in their court. They cannot claim more than the amount of the parking charge from a keeper though (£100, plus court fees).

    The previous letter was the one they send after 28 days has expired AFTER they reckon they issued a Notice to Keeper. So did you definitely never receive a NTK around a month before that Notification? Didn't accidentally file it in with your paperwork for the other one? Would have been dated around the final week of April?

    If not then you need to acknowledge, then respond to the LBCCC as per the LBCCC Fightback thread (among Crabman's collection of parking stickies near the top of the forum). Include the clear statement that no Notice to Keeper was ever served.

    Which car park was this, you can pm me if you like. What is the alleged contravention?

    100% no NtK for the second pcn.

    it was at xxxx car park. Parked on a walkway thing thats next to bays but definitely not a bay

    what is the likelyhood of court as i simply dont have time for that.

    Fairly likely, with UKCPS but we've helped people defend & win before (e.g. UKCPS v Gaskell in April) linked in the NEWBIES thread post #5 in the victories, where you will also see another link to a UKCPS case on pepipoo v a poster calling himself 'Rupert Justice' who got the Court to order POPLA instead! Hence why respond robustly to the Letter before claim and do not leave any reply un-responded to, keep batting the ball back to their court and also ask for POPLA even though it's late because it's never too late for an ADR. Remind them small claims is a matter of last resort, etc., and that you have not had any PCN nor a Notice to Keeper so had no chance to appeal this one at all, and POPLA set no deadline on a PPC issuing a POPLA code. Put this in writing, NOT Recorded Delivery - but just add at the bottom 'Proof of postage of this letter has been retained' and get that from the PO Counter for free (and keep it stapled to a copy of the letter(s) you've sent.

    Go and get pics of the lack of signage, NOW. By the way UKCPS will have read this thread as they hate our 'scam forum defences' (their words).

    Bear in mind that in a court situation you wouldn't keep quiet as to who was driving at a hearing, if asked by the Judge, so the fact there was no NTK isn't necessarily a winning point although no PCN as well, is worth including in a robust defence. If it comes to it, you can do it, or you could make an offer 'without prejudice'.

    There was a thread yesterday where I advised a poster to send a without prejudice offer on a separate sheet offering £20 or so, in the same envelope as their acknowledgement of the Letter before Claim. You could read my posts from yesterday to find it (click on my username).

    pcn cancelled letter came for 2nd pcn hahhaa!

    all from the template i used. im guessing the court esque final demand was already sent in the post before recieving my template or they may just re-reviewed it!?!?

    Has Hasbeen got the sack? Seeing a lot of "UKCPS cancelled the charge" outcomes lately, which is puzzling since Hasbeen was always one of those who saw every challenge as a personal affront.
