Will MOT Fail ?? (Tyre worn out!), but can NEW Tyre in the boot be used to PASS MOT ?

If a car has an MOT, it passes on everything, but fails because of 1 tyre being too worn out.
now in the boot of the car, there is another Spare brand new tyre. (not being used)
by mentioning that there is a spare brand new tyre to the MOT guy
When they mention that the MOT will fail, can the MOT mechanic change the Old tyre with this new one, and then pass the MOT
Would a worn tyre Fail the MOT? or just get an advisory ?
and the main question is:
should he typically be charging for this -to change this tyre?
(as the tyre has been not provided by him)

We will be, if we can find the spanner and jack, which has been misplaced, and have asked around too, but no luck.

but just asking would the MOT mechanic typically charge for something like that, although they parts have already been provided?0 -
some will charge but usually minor like £5 if that..thats assuming the spare is same size as ones fitted..But if you got a puncture the spare would be illegal if fitted..0

the MOT guy is not allowed to do any work on the car whilst the MOT is in progress , he is logged onto VOSA and the clock is ticking.
ask him to change the wheel before the mot , using there tools , leave the bald wheel out of the boot whilst the MOT is taking place , as a bald spare is illegal.0 -
Why wouldn't they charge? You're asking them to use their time to do it. Also, you've just said you've lost the jack etc so not all parts are being supplied. The spare tyre itself is not subjected to any tests as part of the MOT so you can have a defective tyre as a spare (risky if you ever actually need your spare).0

Are you sure? The AA disagree (http://www.theaa.com/motoring_advice/legal-advice/tyres.html)0 -
ok , go by the AA , they are the experts(not) , however I have found that
a: the examiner is not impressed with a badly maintained car (bald tyre in boot)
b: you will get a written advisory on your certificate
I always remove items that might offend the examiner , ie: bald spares LED side lights/flashers/stop lights .

led lights wont make no diffrence as long as they are legal..spare is not tested and mo guy shouldnt be swayed by stuff like that..but then we all know everyone is human and he might look closer at thingsa if he spots bald tyres0

Or also go by the Vehicle and Operator Services Agency (the agency which has replaced VOSA), they clearly state on page 4 of this leaflet https://www.gov.uk/government/uploads/system/uploads/attachment_data/file/195074/CONT071791.pdf that spare tyres are not tested. Therefore they cannot appear as an advisory, although a good mechanic would tell you just to give you the heads up.0 -
ok , stop arguing, leave the bloody tyre in the boot then!0
