    Kurjam and anyone else having debt problems,

    Agree totally with cc99 on this..We see lots of people here getting into a mess because they get court papers and do not respond. If they respond, the case is dead in thw water, because the debt is statute barred or there is no CCA.

    So just take it gently and come back if any paperwork arrives. The only defence you need is the absence of the CCA.

    i have just done the letter to lewis as you said, and realized in the envelope is another letter supposidly of natwest bank, addressed to me telling me lewis have officially taken over the debt.... strange but it is a normal piece of a4 paper with a natwest logl and it is signed collections manager at natwest jack...... i think and this looks like a letter they have typed themselves to scare me !!!

    This is a well known tactic and also it could be illegal to imitate another company infact the FOS may view it as fraudulent. Have you looked at the other links I gave in my earlier post if you go to the CAG website there are many threads of DCAs who have done the same, it may be worth checking out and reporting them for that as well.

    yes looked at the links they were very reasuring, i know its not a proper letter as i still bank with natwest and this letter is nothing like what natwest send out....
    also the credit card i had a few years back was royal bank of scotland, so why do they call it a natwest card, i thought they are 2 different companies??

    i am reporting them to the ifo as we speak, but what exactly is it ia m reporting , is it because they are chasing me for a debt that should not have been passed on ??
    sorry to sound thick but this is driving me crazy ???

    should i mention that the debt as been to different companies trying to get payment....

    You should report them for having passed on personal information despite their being in default over your cca request.

    Natwest and RBOS are not the same company you should make sure you are not being chased for another debt belonging to someone else. Also you should be aware any debt over 6 years that has no payments against it it Statute Barred and therefore unenforceable also for amount of time you did pay it it you could be entitled to claim back unlawful interest charges too. Also the fact that you have had no CCA from Apex you should inform Lewis that they are breaking the law chasing a disputed debt that has had no CCA and the list goes on. I know it is hard to get your head round so why dont you start a thread in Consumer Action Group forum and the experts on there may be able to advise you with some extra information that we may have overlooked.

    the credit card i had was rbos but i presumed natwest was the same company, pretty sure i never had a natwest one, named this thread natwest as as i say thought they were same company.....
    but all the paperwork i have have the same credit card number and some say natwest, some say rbos.....
    so very confused !!

    I think you should get this checked out, make sure all the account numbers and correspondence is referring to your Natwest Card, if you took out a NATWEST card that is what all the paperwork should refer to, I dont know what the link would be with the BOS maybe Rog or anyone else can confirm wheter this is the same company, are you sure there is no other debt you could have forgotten about?
    Remember ANY debt over 6 years old is Statute Barred and it is illegal for a DCA to pursue this.
