    just got a letter from apex...
    we must speak to you immediatly regarding the above debt
    please telephone the number below... !!

    what should i do, i dont want to speak to them prefer to write to them, as from past experience with the other debt collection agencies that have delt with about this debt they can be very rude.....

    Write to TS and the OFT and the IO about the "debt" being sold on.

    And do not speak to APEX. See what you get back from the above.

    And then send a copy of the letter to APEX.

    :mad: got this back from apex,
    Our clients have informed us that there is no valid dispute on file and that the full balance is required

    Please contact our offices on 0871 *** **** to arrange payment of this balance.

    what do i do now ?? shall iwrite to them asking for copy os the original cca like i did with the other debt people, and also a copy of the letter that royal bank of scotland sent to them ??
    please help, just feel like giving up and paying them !!!

    did think they may just be saying that so i make payment, as it did not take rbos long to reply to apex, thought they would have took longer !!

    Account passed to new DCA/solicitors while the original is in default of a CCA request.

    FORMAL NOTICE - ACCOUNT IN DISPUTE

    Dear Sir or Madam,

    Account number: XXXX XXXX XXXX XXXX

    I must admit that I am rather bemused as to why this account has been passed to yourselves, as it is in dispute with the **original creditor/DCA** and has been since DATE.

    Not only is this a breach of OFT collection guidelines, but also in breach of the Consumer Credit Act 1974 and Data Protection Act 1998.


    As **original creditor/DCA** are now in default of my Consumer Credit Act request and OFT Debt Collection Guidelines, I consider this account to be in SERIOUS DISPUTE.

    As you are aware while my Consumer Credit Act request remains in default enforcement action is NOT permitted, under s127 this constitutes a complete defence at law.

    Consequentially any legal action you pursue will not only be fully and vigorously defended, it will ALSO be averred as both UNLAWFUL and VEXATIOUS.

    Now I would respectfully suggest that this account is returned to the **original creditor/DCA** for resolution of these defaults and breaches, as **New DCA/Solicitors** cannot lawfully pursue any enforcement activities.

    If **New DCA/Solicitors** chooses to ignore my dispute and attempt enforcement, I will initiate legal action and file reports with the appropriate authorities, including, but not limited to, Trading Standards, Office of Fair Trading, Information Commissioners Office, Financial Ombudsman Service and possible court action.

    After taking advice, I am of the opinion that any continued pursuit is in violation of the Administration of Justice Act 1970 section 40 as well as breaching a number of the OFT Collection Guidelines

    I hope that this will not be necessary and an acceptable solution can be accomplished.

    I would appreciate your due diligence in this matter.

    I look forward to hearing from you in writing.

    hi Ras, had a strange letter this morning regarding this account....it has actually come from Natwest bank.....it reads like this
    Dear **** *****
    thank you for contacting our agents with your complaint regarding the above account. I am sorry that you felt the need to raise this issue with us. (have never written to the bank of scotland or natwest)
    your case is being investigated fully and you will be provided with an update or full response with in the next 10 days,,,,

    what do i do now ?? obviously apex were lying when they said that the client (credit card provider) have said there is no dispute, they are just trying to bully me into paying.......should i still send the letter above, or send a copy of my natwest letter to apex, just to show them i know they are lying....

    I got my CCA and up to date statement from MINT on behalf of them, so i sent a letter to AIC offering payment terms and have never heard anything since. That was a few months ago.

    I'm confused. Why would they come all this way and drop it now, when they are due the payment?

    Aic went quiet on me for nearly a year, then the debt re-appeared with the new debt company......may be they are selling it on, its so frustrating though when they hassle you and when you try and sort something out they shut up altogether !!:mad:

    shall i ring trading standards etc ??
    i am worried about getting other people involved in this, incase they say i am wrong !!
