    Thanks for your advice but I want to avoid going into arrears if possible. I think I will try complaining to them (again). There's still some time before the next DD is due but I definitely can't afford to pay another one. This is a sick joke!

    dizzybuff - Is it the child maintenance that takes you over the threshold? I can't see it being right that Erudio are taking this into account when it's for your children (I also don't agree with the other benefits being included, but I always had to declare them to the SLC - no idea if they actually included them in any calculation, but I've been way under the threshold since I became a SAHM).


    I think it would help if you contacted MSE (they were tweeting today for info on how Erudio are behaving). Also, Simon Read at The Independent has written several articles on Erudio and I'm sure would be interested in your story [EMAIL="s.read@independent.co.uk"]s.read@independent.co.uk[/EMAIL] - It would surely be very bad press for Erudio if the fact that they are trying to get their claws into child maintenance money became public?


    Have Erudio officially refused your deferment? If so, you could make a formal complaint to them, disputing that they have classed this money as your income - that will at least put repayments on hold in the meantime, and buys you time to speak to the media and find out for sure about the child maintenance/benefits.

    You could also copy in Erudio's Director [EMAIL="MFiler@WilmingtonTrust.com"]MFiler@WilmingtonTrust.com[/EMAIL] - I've had several responses from the Capita office as a result of emailing him.


    If your complaint disputes the repayments (which are down to Erudio's excessive delays/incompetence), they have to put any collection activity on hold while they investigate your complaint - that should buy enough time for your deferment to go through.

    I second that. They should not be taking a penny.
  • I've had several phone calls with Erudio now and have noticed a pattern...

    They claim to not have received paperwork unless you push them. Then it magically appears on their screens.

    They tell you things that they haven't put in writing such as you are in arrears and owe them money, but do not give you any amount despite being asked.

    What is most worrying to me though is that they are outright LYING. I have been told several times that they have no obligation to tell me how much they are seeking as a repayment per month until I give them my bank details. This is absolute rubbish (I was going to use another word, but I'm trying to be polite!)

    They are claiming I have been unsuccessful in my deferment due to me not sending in my tax return. My reply has always been the same. Show me where it states I have to provide you my tax return and I will send it. I am then met with demands and demands rather than an answer. It is quite clear that they do not know the relevant parts of the law. Interestingly, I am yet to receive any form of official letter from them stating my deferment has been unsuccessful and that I must start repaying my loans.

    They also have refused to acknowledge a regulated agency acting on my behalf, despite receiving a signed declaration from me and two emails from the company in question. All in all, this is starting to make me rather pleased....

    Why? Because they are scaremongering and bullying with no teeth to back it up. They are playing fast and loose with the law and when I get the go ahead I will be putting in a rather large complaint. I believe the debt advice agency is also considering a serious complaint due to Erudios non compliance. If they try to take me to court for non payment, they clearly will loose due to their non compliance and lies.

    They have also failed to respond to any of my questions I raised in my letter dated 3rd April. This again, shows me that they have no interest in acting responsibly as well as my repeated questions as to the proof that they are legally allowed to see my tax return. (FWIW I did call HMRC only to be told they could not advise on this....I would really appreciate anyones input as to whether they can indeed legally expect to me to send this in.)

    I do however, have one concern. For those on this forum and others yet to meet such a company without any knowledge of the kind of lies they would tell in order to get what they want. This type of harrasment is very likely to tip someone over the edge and have them seriously contemplating serious harm to themselves. I dearly do not want this to happen which is why I am fighting them.

    Erudio's approach on people who are vulnerable is also one of my main reasons I want to take my complaints further too. I hope other people complain too, as one or two people saying something probably won't make much difference.

    I am just waiting for a copy of my original student loan contract (it's been five weeks now...) before I take my complaints to the FOS.

    Btw, if anyone knows a way to speed up the process of actually getting a copy of a student loan contract, I would be very grateful!
  • 2 working days and no response to my complaint, not even an acknowledgement. I've just cancelled the dd. I wonder how soon they'll contact me about that?

    2 days lol . You will be lucky. They have not replied to my first complaint from over 6 weeks ago! Though they have acknowledged receiving it!

    Seriously though, don't panic. They will try to wear you down with fear and uncertainty. I sent all relevant docs by recorded mail a month before my deferment date. The fact they want to delay/ bully/ be really really bad at their job (or good:they are a DCA after all) is their problem. Just hang in there, they are all bluster and threat. I do not think anyone has had their deferment rejected IN WRITING (with the reasons for rejection outlined) for not producing all the paper work Erudio are trying to insist on. When/if that happens we can then challenge it via FOS and in court.

    I would urge everyone to complain via all channels and make all our voices heard.

    I just want to thank everyone for this thread, particularly Tommygunn's post below, which I found via Google. My husband got a letter this morning to say his loan has been successfully deferred, after only 17 days of waiting.

    We filled the form in as outlined below: contact details, income info and bank details were included, and the form was signed, but the NI number box and the homeowner/tenant question was left blank. The terms and conditions were blacked out with a big fat permanent marker, with "SEE ATTACHED LETTERS" written at the bottom, and we sent modified copies of the letters Tommygunn posted (see below) stating that my husband doesn't consent for his credit files to be searched, and that he was only providing them with the information needed to assess his deferral request (pretty much copied tommygunn's letters word for word).

    The only proofs of income we sent were copies of his last three pay slips. No P60, nothing else. We sent it by recorded delivery. They have set up a direct debit, so my husband will keep an eye on that, but so far, everything seems to have gone pretty smoothly.

    Tommygunn, if you see this, thanks so much for your post, and massive thanks to whoever drafted the letters. We really weren't happy about Erudio having the information they demanded, and this goes to show their claims that they need it/have a right to it are utter BS.

    What happened?
    The end date for my deferment was due on the 14th July and I emailed my documents to Erudio on the 17th June.     With the help of Anna2007, I sent in nine pdf pages. This is what I did.

    Erudio doc page 1:
    DOB: Yes
    NI no.: Blank
    Address: Confirmed - everything else blank
    Other contacts: Landline and alternate email.
    Everything else blank.

    Erudio doc page 2:
    Current Account: Yes
    Direct Debit: Completed in full

    Erudio doc page 3 to 5:
    Filled out as per circumstances

    Erudio doc page 5 to 6 T&C's:
    Everything erased in MS paint with 'See Page 7' superimposed.

    My docs page 7 & 9:
    These consist of the two letters doing the rounds which I slightly modified, see attachments below. Sorry I can't say thanks directly, as I've forgotten who did them, but thank you all the same.

    My doc page 8:
    A letter from my wife declaring that she is the sole earner and supporting me to no more than £2398 per month and that I don't actually get any physically payments.

    That's it, nothing else.

    So, apparently my deferment is confirmed but I will be keeping a close eye on things and I'll be waiting for my confirmation letter which they say is in the post.

    p.s. a DD has been setup on my current account so, as mentioned, I will be keeping a watchful eye and if anything happens I will be merciless.
