    I read earlier in the thread that Erudio's argument about needing to share data to receive data might be bobbins due to their parent company already having a data sharing agreement set up. Did anyone find out if that was true or not? I think it was Fermi that was going to try to look into it.

    I sent back a letter instead of the form, and after a formal complaint Erudio are refusing to process my deferral. I've contacted the FOS, but given the "light touch" regulation that seems to allow large companies to do whatever they wish I don't hold out much hope.

    Erudio now claim I'm a month in arrears, impossible due to me not earning enough to be required to make any payments.

    Do I wait 3 months for them to call in the loan, take me to court and then counter claim for breach of contract (after all the are refusing to let me defer)?

    Or should I take them to court for breach of contract now?

    In which case what am I claiming?

    I don't want any money out of them I just want them to defer me as laid out in the original loan agreement.

    Why not use the form and just cross out the parts you don't like?

    No need for a fight when one isn't needed.

    Yes you do. The ctc and wtc letters must be dated within 30 days or they won't accept them. I also had to send a copy of my Child Benefit letter which I had to get especially for my deferment....CB don't send letters out as often as ctc and wtc.

    with the 'Experian Collections Network' Arrow created, pays for and controls, i would suggest they are doing slightly more with our info as well. I would recommend people finding out about that as well and trying to decipher what that network actually is.
    Certainly Experian and Arrow have very close intereests that dont seem to have been disclosed in the open yet, despite Experian seemingly coming out and defending Arrow to some extent on those You and Yours progs and in Simon Read and the other guy from the BBC in their reports/articles.
  • The Deferment Threshold from September 2014 might go down from £28,775 to around £27,000 (might be as low as £26,700) down to what it was five years ago.
    How can we plan our finances properly when we have little idea from year to year whether we have to pay back some of our loan or not.
    If the Threshold does go down then it’s down to Bankers’ bonuses and the way the Government does the calculations (they are done by the Government not the SLC).
    How unfair is that.

  • Erudio finally send a letter about the deferment dated 16th July which is 43 days since they received my information via email (3rd June).

    They have declined the deferment because: -

    1) They need confirmation of gross monthly income, the last 3 month's consecutive payslips.


    I sent them these with the email. They haven't got my payslip for May because they are given on the 7th of the next month. So the fact that they haven't got my latest payslip is because they have taken to long to process my deferment!


    2) They want a p60 form.


    I don't have one of these because I work abroad. It is irrelevant to my case and as far as I know, is not required according to the original agreement.

    3) They want a copy of my contract.

    I can give them this if necessary but it will only confirm what is already on the payslips. Plus I don't think this is necessary according to the agreement.


    They have already had 2 dds from me but I've cancelled it now, so I guess I'm going to go into arrears and get a bad credit rating.

    I can't believe that it has taken so long to make a decision when all the evidence was provided and a glance is all that is needed to see that I earn way less than the threshold. Even so, they could have told me their objections way earlier instead of waiting 6 weeks plus.


    Also they had promised to email me their findings. They didn't.

    I guess I need to write another complaint and CC in the names of their 'big cheeses'. i think I might now write to my MP and anyone else who can help.
