The problem with borrowers not receiving DAFs this year does seem rather widespread. I've thought perhaps this approach might be helpful in dealing with the problem.
1. Complain to Erudio, either by phoning FOS or emailing [EMAIL="complaints@erudiostudentloans.co.uk"]complaints@erudiostudentloans.co.uk[/EMAIL] etc
2. Tell them they haven't sent out the DAF as prescribed in the Regulations, and ask them to send a printed version to your home address.
3. So you are not disadvantaged, and to rectify the breach of the Regulations, ask them to have to your deferment date moved back until it is 8 weeks from when you eventually receive your printed copy of the DAF.
4. Ask for redress for inconvenience.
If they are unable to resolve it as per above, you can take them to FOS.
I tried to look back on the thread before and find where it said about 8 weeks. What regulations do I need to quote?0 -
Its in the sales and purchase agreement that was released, and Anna's Erudio reply where they said it was 5 or so weeks, then wrote to her again highlighting their error and saying it was 8 weeks.
My interpretation is that the DAF has to actually arrive 'at least' 8 weeks before the deadline to the persons house. Erudio are quoting this to mean that is for them to mail it out 8 weeks before, or date the accompanying letter 8 weeks before. But then it takes a few days to put in an envelope, get posted out and delivered.
Either way, it seems that they have only sent the '5 weeks to go' letter out this new deferment year with Capquest in control.
We should all be lucky when we complain because i know Erudio's response will be 'we have done everything correct and cant be held responsible for the postal system', which will then allow us all to complain to the ombudsman. If we do so in numbers it will be clear it is a tactic, not an error with the postal system. Lucky, because this will mean compensation for wasted time/inconvenience and a big fine!0 -

I am not surprised that my deferment form hasn't arrived - think I would have been more shocked if it had!!
I am not messing around this year and they are annoying me so much that court will be involved if they mess me around. I have already copied all my stuff for my complaint so will do that after I fill in the DAF - which I had to chase (twice) and get emailed to me (not within the 5 working days they promised!).

A friend of mine has had similar problems, namely the deferment form wasn't sent out/did not arrive. He then received a letter from them stating repayment dates, starting in May. He absolutely cannot afford to re-pay.
Strangely enough, some of my loans are also with Erudio, yet I did receive a deferment application form in good time and my deferment has been accepted.
On contacting them, Erudio told my friend not to worry and that there has been a mistake in sending out the letters, etc, and that he will receive a deferral application form. I will suggest to him that if it does not arrive this week that he gets on to them again.This is a system account and does not represent a real person. I assume yours are assessed by SLC so Erudio would follow protocol very closely so as to appear the model company, however, if your friend has loans only with Erudio there will be no one watching that Erudio follows protocol. I was told a similar thing to your friend, minus the mentioning of a mistake. I was told the DAF had been sent out with a letter dated exactly 8 weeks before the deadline....which, to me, is also breaking protocol because the sales and purchase agreement says 'not less than 8 weeks' etc. However, it never was sent out, it was the first of their lies. I suspected as much at the time, now i am not the only one, one can only consider it to be Erudio's new deferment process if you do it all by mail. They of course want everyone to do it online via their online data collecting new sales stream portal, or via email, as it will be cheaper.

Back again - clearly this will be an annual thing!
Just posting to say that I have also received a letter with 6 weeks and 6 days to go stating my repayment terms. It doesn't mention anywhere anything about "As we haven't received your deferment form" or anything like that.
Working out the dates as per the Sales and Purchase Agreement erudioed posted above, and taking into account the section of the letter which says that the form has been sent under separate cover (why?!);
If I was to wait 14 days from the receipt of the letter (01.04.16) to ask them for another form as they request, this would be 15.04.16.
Then wait 5 business days to receive form takes me to 22.04.16. Then send it in, allow 28 business days for processing, assume an issue and add an additional 28 days, this would take me to 01.06.16 or 11.07.16 respectively. My deferment date is 19.05.16… Even without any issues this will not be resolved until 01.06.16 at the earliest.0 -

Good news: Martin Lewis/MSE is going to get involved on Monday, and hopefully not take the Post Office/computer error response by Arrow Global at face value, especially considering this is the 2nd year in a row for May deferments that the DAFs werent sent out at all, or sent out 6 weeks before the deadline (arriving to the house less than 5 weeks before the deadline).0

Been reading this and Mum's net threads, and others, for a couple of years now. Have a question about my loans that i haven't been able to find answers to in these threads, probably due to their size.
I have loans from 94/95/96/98/99/ and 00
I'm sure i did read somewhere that even though i have loans from post 98 that because i have loans pre 98 also they would all be considered 'mortgage style' and would all be handled together and hence all transferred to Erudio. Is this correct? As this is what happened.
Secondly, as there are different regulations regarding when loans would be written off will mine all be written off when i am 50? Even those taken out for the years 98,99 and 00?0
