ERUDIO student loans help

  • I have just done a Google search regarding Erudio loans to try and find comments posted within the past 24 hours, and discovered a comment from someone on Mumsnet about their antics. The comment appears as part of a discussion called To be really quite cross about this letter?, and has been made by someone calling themselves Coffeethrowtramp***** (that last word is a swear word, but MSE won't let me post it grrrrrr). The same thing has happened to her that has happened to many of us. I tried to post a link on here to the discussion on Mumsnet, but MSE won't let me because I'm a new user and it thinks I might be posting spam (grrrr again). If you want to see what was said, you'll need to Google 'Erudio loans' for a time period of the past 24 hours like I did, and a link to it should be displayed in the results of your search.

    I don't really want to join Mumsnet, but I was wondering if anyone else posting here is already a member of Mumsnet and would like to point the individual concerned in the direction of this discussion? The more people contact Emma Lunn about Erudio's dirty tricks, the better.

    You are right Dave. It is called fraud by misrepresentation. Erudio has misrepresented that they could give our details to CRA's when in deferment, plus lots of other things, like saying they would pass the data outside the EU. (EU Safe Harbour Ruling)

    Misrepresenting can make all Consumer Credit Act 1974 agreements void under Section 56 I think it is. I read through Scots Law commision guidance on that. Either A: The Student Loans Company misrepresented when selling the loans, by saying that we would never be reported to CRA's, when we took out the loans. Or B: Erudio is now misrepresenting what the Student Loans Company said. They cannot have it both ways. Erudio are now beat with this. I think I have beat them.

    IMPORTANT BELOW:

    We should all be due compensation under another area in CCA 1974 Act. I am working on that. They have redacted part of the Government to Erudio Purchase Agreement (Section 11) to cover up, the fact that they will be due thousands of people compensation. Not just to us having to deal with Erudio, but all borrowers. All we need is one claim made by a borrower, and the floodgates open.

    I need everyone who has old Student Loans Company statements, to look at them, and let me know what was printed on the back of them? This is important. Please fish them out and report back, redacted PDF's would be of great help please. Does it say "how to repay your loan early on them?". Mine do not. This is in breach of Consumer Credit Act 1974. An FCA decision recently forced lots of banks to pay out over this, the Student Loans Company, may be forced to do the same. (Hence why, as Mr McGuffin pointed out, Honours Student Loans has £10 million set as a provision for it.)

    Erudio is liable, but in their Purchase Contract, they have the government on the hook for any claims made by a borrower. What a shambles. "Camoron", Osborne and Calamity Cable punt off the loans, to cook the books, and leave the government on the hook! lol

    Anyhow, please EVERYONE, look out your OLD Student Loans Company Annual Statements and tell me what is on the back of them?

    One of my statements does not include any early repayment information, so that one is in breach of Consumer Credit Act 1974.

    There is probably something else also missing. Hence why they are desperate to cover up section 11 of the Purchase Contract.

    There is also stuff in the Purchase Contract, that corroborates that Erudio have breached parts of the Sale of Student Loans Act 2008. I will put more up when I have time.

    Update on Erudio Website this morning- the press looking into the situation has obviously got to them! That first line is complete BS though. A "Deferment Application pack", really?? More like a letter demanding repayment!

    Deferment Application Form - Update on missing forms

    We have identified a number of our customers received their Deferment Application packs in March, which unfortunately, did not include all the relevant paperwork. In some cases, this included the deferment forms themselves. As a result of this, at a later date some customers were sent reminders having not previously received relevant documentation.

    We apologise unreservedly to those customers affected for any inconvenience caused. To resolve this issue and ensure it does not happen again, we have performed a thorough review of our procedures, identified the issue, concluded that it was an isolated incident and have put additional measures in place to ensure it is not repeated. We will be contacting all the customers impacted in the next few days. Their deferment date will be extended to ensure they have 56 days to apply for deferment. In addition, the maturity date on their loans will be extended to ensure there will be no financial detriment.

    Erudio is a business committed to maintaining the very highest standards of integrity and professionalism. Building strong ties with our customers and treating them fairly is really important to us. We deeply regret this incident, however, we are confident that the issue has been resolved and we look forward to contacting our customers to rectify the issue. In the meantime we would welcome any calls from our customers.

    Also while I'm glad they will be extending the deferment dates, is it really in our best interests to have the maturity date extended or theirs?
