    You know if erudio want to start playing funny, saying they didn't receive deferment forms etc. Why can't we? oh I never received a notice of assignment for example.
    It is up to each person but, I think if you are under the threshold and just sit tight (and keep records as proof) there is nothing erudio can do to you, they may threaten court after not deferring you for stupid reasons but you will really just end up with a lot of paper to light fires with.
    At the end of the day the country is a cesspit. Payday loans companies (American owned), fixed odds betting terminals, corruption (security tags for dead people or those that never existed), large coffee shops that drive out independents and have somehow never made a profit in ten years. zero hours contracts (no NI for you!), workfare, unpaid internships, restrictive planning laws that keeps people living in damp moldy buildings that should have been knocked down years ago.

    i cant argue with that, i was just trying to be more balanced and less personal in that one. I didnt realise our beloved leader, Mr Mark Howard Filer, lives in a tax haven? Not a surprise though because he is director of at least 2 companies registered in them...
    Apparently he has that driveway paved with the blood and teeth of all those debtors who thought they had gotten away but that Mr Filer and his fellows managed to locate, psychologically torture and extract money out of their bank accounts. Making lives as miserable as this bunch do, they deserve the good life because one day they realise just how negative their line of work is...and if they dont, then that is because they are psychopaths incapable of anything other than a mighty large hard-on thinking about how many trashy debtors lives they have managed to destroy. After all, they will think, if someone has a debt, they should be forced to pay it back...

  • Something very interesting has just been discussed on the Mumsnet forum. It seems that Erudio have not actually notified anyone of the amount to be debited from their accounts each month- I for one have certainly not been informed of what the amount would be, whereas the SLC always informed me well in advance of the amount to be paid each month if I had not been eligible for deferment. Erudio is clearly breaking the terms of the Direct Debit Guarantee.

    Whenever I have arranged to pay for something by Direct Debit, I have always been informed in advance by the company concerned of the exact amount to be debited from my account. As Erudio have not done this, they are not entitled to take any money and have effectively stolen money from people's accounts. This is something which really ought to be flagged up by the press.

    As you can see, it is very clear that a company is not allowed to debit money from anyone's account without having first informed that person of the amount to be taken, something which Erudio have not done. I suggest that everyone cancels their direct debits and, if there are any threats from Erudio about court action etc, calmly inform them that they have broken the regulations governing direct debits.

    I thought it said in the SLC T&Cs that that is the process as well...forewarning and then fee taken. Can anybody confirm that because if so, that is two T&Cs being broken, with the very important SLCs ones particularly pertinent if they have because of the other issues of debate and their potential breeching.

    I've been told got arrears on my account can't defer and must make payments.

    I've always contested these arrears as they said we haven't revived your deferment letters yet was aloud to defer 3k on top of the loans these guys have taken the Michael and have operated with a load shark mentality
    I've been told you can't defer any more

    I've been signed off for last four years with constant back issues major operation coming this has really stressed me out

    I haven't got anything for them to take

    Any advice ????

    I may have declare myself bankrupt

    Apparently SLC did not act within the law by not disclosing arrears properly within the period mentioned in MSE's article.

    If you have arrears on the account and don't pay, then under the terms of the agreement they can demand the full amount of the loans be paid back immediately and no more deferment allowed.
