PCN from PPS at Hull Port - Received NTK - What next?

    Make complaints to the dvla and bpa about this, you've appealed they have not responded, post #6 in the sticky thread by coupon mad has the addresses.

  • I have done both those things.

    Had no response from BPA.

    Had response from DVLA and I know when the data for the vehicle was requested and released. I have asked for further info for exactly who requested it etc following the parking prankster blog.

    My issue is that PPS have used CCS to send the first letter/NTK. The appeal address on the letter is CCS's address, this is where I have posted a copy of the email appeal I sent to PPS to. The letter/NTK is exactly the same as the first letter in the CCS collect letter chain except it appears that CCS are posing as PPS by using their logo in the top RHS corner.......

    I dont want to miss getting a POPLA code so I was thinking of posting another copy of the inital appeal & copies of correspondence with BPA and DVLA to PPS directly. PPS did acknowledge my email appeal but have not yet had a response.

    Should I just sit tight and wait for a reply from either CCS or PPS via e-mail?

    They will not respond to you, this is the scam they are pulling. They are just interested in the money they are trying to get off you. I would write back to them giving them 14 days to either accept your appeal or reject and supply a popla code. Inform them that if they do nothing then they have lost the ability to hold the keeper responsible, so the matter is closed.

    Did you use coupon mad's wording for the appeal?

    When you say write to them, do you mean CCS or PPS?
  • I don't believe they have the ability to hold the keeper responsible anyway, as they do not mention POFA...or am I wrong?

    Write to the parking company as they are the only ones who can give the popla code. As for complaints I would go back to the bpa and dvla with the situation now.

  • I will write to PPS then and state the 14 days bit you mention above.

    There isnt really anything extra to say to the BPA that I havent done so already, I will chase them regarding my original email.

    Awaiting further info from the DVLA.

    Am I right or wront regarding POFA above & keeper liabilty?

    I could wait until the 28 days after NTK was sent and then just tell them I cannot be held liable as their NTK does not follow POFA 2012?

    If they are not using pofa then there is no RK liability, and they can only pursue the driver, so don't tell them who that is, always use registered keeper instead of I or me

  • Yes of course - as I have said throughout the thread.

    What would you recommend though, waiting until after the 28 days since NTK is dated after which they cannot pursue me as RK as they do not cite POFA?

    Or postal appeal in the hope they cancel or send POPLA code so I can win and receive not more letters from CCS?

    They don't have to cite POFA in order to pursue the RK but they do have to comply with the strict requirements of POFA if they want to pursue the RK especially with regards to the timescale for delivering the NTK. If they fail on that single point then they cannot pursue the RK for unpaid parking charges.
