I look forward to reading through this and other threads... just a quick question (and please don't shoot me down!), is it still appropriate to appeal if you did park (in my case) in a Superstore's car park without the intention of using their store?

Have a good read at other threads, search JAS parking for similar people who had a pcn from them. Also take all advice given to you from the people on here they are really good and have helped loads. And good luck0 -

JAS only seem to haunt Staples car parks - you will find other threads about them if you search this forum for 'JAS Staples' as keywords. See the standard appeal template in the NEWBIES thread - and as JAS are what I would consider 'small fry' then my advice is to send the template appeal NOW in response to the windscreen ticket. This gets you past 'GO' a lot quicker and onwards to a POPLA appeal. Remember to use the template - not your own version - because when I say 'appeal NOW' I still mean appeal only as the registered keeper, who has of course seen the offending 'ticket' on the precious car!PRIVATE 'PCN'? i've been doing some reading around this, and i'm not sure that i should contest the ticket... primarily as i admit i did not use the car park appropriately (i was running late for a meeting and had to park somewhere, with no change for other car parks!)
so i took a risk, and lost.
i'm worried that should it get further down the line, i'm not going to have any evidence or excuses.
i also don't want to risk any flags on my credit score, etc.0 -
if we assume you are "guilty as charged" then what do you actually owe ?
if we assumed a few pounds to the landowner and admin to get it then if we said £12 then that is what the OFT decided but which wasnt agreed with the BPA etc

so if we assume you owed £12 and the ticket said so then yes maybe you should pay it, hope you agree , this is a genuine pre estimate of loss
now this also assumes that JAS have the landowners permission in writing to issue tickets on their behalf, that the signs complied with the BPA CoP and that the gpeol was applied
JAS rarely do any of the above caveats so this is why you appeal, because they are not playing fair and are cutting off your arm just for stealing a mars bar !!
so lose the guilt complex and decide if you owe some money for parking, assuming you do but not between £60 and £100 then appeal it, if you win at popla etc then put £10 or so in a charity fund or help the heroes or whatever to absolve yourself
basically, the punishment does not fit the crime and the parking charge does not reflect the loss either0 -

so even if they do have permission from the landowners and their signs are compliant, then i'm appealing on the grounds of excessive penalty / unfair punishment.
as I have 14 days to pay a lower fee (£56 instead of £94), if my appeal is unsuccessful (for argument's sake), am i still entitled to pay the lower fee if i start the process within 14 days (i presume i have to inform JAS of my intention to appeal, i'll read up on that)0 -
I am not going to get into the semantics of when the deadlines to pay are , its a slight gamble but you put the onus of proof onto them and there are a few JAS threads on here where they have caved in due to the punishments meted out not being viable, which yours clearly isnt at either rate you mention
so I would appeal and to h*ll with it , then use a poor box if you feel you should, or go to staples and spend some money in store , etc , putting right a perceived "wrong"

he had trouble getting the popla code but I think the PCN was cancelled in the end

This forum is fullof successful appeals and victories at POPLA.
If they work for someone else, why not for you?? The only thing you need to do is follow the NEWBIES thread, use a successful appeal based on no contract and GPEOL that has worked, read the POPLA Decisions thread for confidence and make your decision about whether or not even the reduced offer is a fair retribution for the alleged contravention.
But if you are minted and want to throw money around, we can't stop you, only give our advice and opinion.0
