    I go away again Monday afternoon and was hoping to get everything that needs printing, sorted before I leave. Then I can send it to the court before the cut off date, whilst I am away.

    I can't pm a court bundle - there is no such thing, you can't template a court defence argument. It just means re-stating your appeal, and stating which cases you will rely upon (these are the cases you intend to bring to the hearing in triplicate for the Judge and the PE rep and yourself). They are called your 'exhibits' and will include appeal cases (= persuasive decisions) like CEL v McCafferty, ObServices v Thurlow, and info about the Parking Eye v Beavis case having gone to the Court of Appeal. You don't have to attach them yet, but you must refer to them clearly and be ready for the hearing with it all handy.

    You should also include a brief 'witness statement' single sheet staying the things that are true such as 'I am the registered keeper of the vehicle xxx xxxx' 'the car was parked but I was not the driver/or I was the driver' (whichever is true) and other basic facts (not opinion or legal argument). Can include facts like, if any 'Letter before Claim' was NOT received, if PE never offered POPLA, etc. This statement is simple, short and must be signed, dated, name and address of defendant.

    The Judge's version you send tomorrow including your clearly stated defence and witness statement, should be in Times New Roman 12 font and 1.5 line spaced, all very clear with numbered exhibits mentioned and written concisely if you can do it (to get the Judge more on your side, maybe, earns you brownie points which PE's pile of 40 pages won't!). You could even put it in a cheap plastic ring-binder or folder and hand deliver it to the court before you go.

    You must send a copy of your court defence/witness statement to Parking Eye. That version must have the same sheets but no need for the folder!

    Finally with your defence if you'd rather keep trying (politely) to persuade the Court to vacate the hearing to avoid it (i.e. if you aren't confident about the hearing, as lots of people wouldn't be!), you could ask for the case to be stayed for POPLA or for the outcome of the PE v Beavis case at the Court of Appeal, due to be heard within the next six months. The wording for that letter is in the NEWBIES thread post #5 - I suspect you've already tried, but try again! I have heard from other posters though that when they asked twice, it worked and their Judges have stayed their case at the last minute. The most recent pm I got about that was last week on pepipoo from someone who was worried about pee'ing off the Judge but tried again to get their case stayed for the Beavis outcome and then to their relief they got an order back, agreeing to stay their case after all (their second letter worked). This was a poster who was worrying their socks off about the hearing and would much rather hang on the coat-tails of Beavis in the hope he wins.

  • Hi guys i need some avice,
    Ive looked throught the forums and found lots of good letter fomats and info on unfair claims etc.
    Im my case i parked in a private car park and exceeded the 2 hours by a couple of mins.
    Im now having latters county court and the fine is up to £185.
    Origionaly the fine was £30, I took the advice of egnoring the letters but my fear is the cost may ramp up evan more and ill haveto pay the fine.

    Is there a way out?

    The 'way out' is to please start your own new thread, not jump in on someone else's as no one will know to whom advice is being offered.

    But, before starting your own thread you need to read the NEWBIES sticky at the top of this forum's index (one page back from here). I don't think you've read that yet as you are talking about ignoring this and thinking it's a 'fine'.

    The sticky will guide you through this successfully if you study it carefully and work through the various stages. Come back on your new thread if there is anything unclear to you.
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    Perhaps we could compare notes prior to the hearings? I have started reading the waffle PE have sent me and one thing they mention is that my defense has been prepared using 'templates obtained from forums lobbying against PE'. I would hazzard a guess that quite a bit of that 'waffle' is identical to the 'waffle' you have received...... hmmmm, so how can it be ok for PE to use templates and not the INNOCENT DRIVER!!!
