Good spot - I was guilty of skim reading at work while having a late bite to eat!

What does the court info say, do you have a hearing date or have to submit your statement and full defence bundle yet?

OK so refer back to post #5 of the NEWBIES thread as there's a link or two to advice from bargepole which mentions the N180 form and you should tick for mediation (but put 'POPLA' clearly next to it)!

And then look at this thread on pepipoo where I have just updated the sort of letter to then send to the local Judge (and email a copy to PE) to try to shove it to POPLA after all (keep trying):

    http://forums.pepipoo.com/index.php?showtopic=90566

Some people have had success by sending this letter with or immediately after the N180 form. Can't promise your Judge will play ball but some have!

Just catching up with this thread - do keep up the pressure of POPLA - state that this has even been decided at court hearings (Lainiee's case - although covered by Equality Act - proves that POPLA is not time barred)

Also bet you have not had a copy of this lease yet ......

Make sure this is demanded - of all car parks not surprising that at Newquay Golf Club - a lot of business is carried out on golf courses. Therefore the terms may be relevant if demonstrates considerable benefits in lieu......of parking services...

I have previously sent an email to PE with a deadline to send me a clear rejection with a POPLA code or I would assume the matter closed. They replied with the normal blurb about POPLA no longer being suitable so I sent another email to inform them that POPLA has no time limit.

As I have received no reply to the email, I am tempted to send another email to assume the matter closed - anyone agree??

I would keep up the emails but if they are proceeding and you've got your DQ you can't really say you 'assume the matter is closed'. Anyway on the thread I linked, I showed a letter to send to the local Judge which should follow the DQ N180, as soon as you know it's allocated locally. And you should send a copy to PE so they get to see everything. So that's what I would email to PE, a copy of your request to the Judge seeing as they have refused the ADR of POPLA you are officially asking the Judge because there is 100% chance that the case can be settled via POPLA (since all cases are adjudicated one way or the other) and PE's reasons for refusal are without merit.
